Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are “spoofed” numbers, so that the number appearing on a consumer’s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer’s social security number, home address, e-mail address, names of family members and the consumer’s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as “We’re filing an affidavit against you” or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General’s Office was repeatedly called both on her cell phone and at work.  Despite the employee’s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an “officer”.

“I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ‘If that’s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming’,” stated the employee.

“It is important for consumers to know their rights under the law,” Attorney General Six said. “If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.”

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer’s arrest, or using the threat of violence.

More information is available on the Federal Fair Debt Collection Practices Act at http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf.

I dont know where you all are from, but I am from Arkansas and I just recieved one of these phone calls a few hours ago. He had called my job looking for me. He proceeded to give the phone number that I needed to call and gave the name Brett Clark. When I recieved the message from my office, I then quickly called the number. When the guy answered the phone he told me his name was David Clark. He told me that I was going to be recieving papers from the police and toldf me the crime against me was for taking money from a loan day place and not paying it back. I then told him that I didnt know what he was talking about and before I could get my next questions out he transfered me to the payment place. I then hung up the phone. When he called me back the phone number was not the one that I had dialed. It was (111111111). I then knew that is was nothing but a scam. I to want to know how they get your phone numbers and such?

I live in Ohio and have received multiple calls at work and on my cell over the past several days.  These calls were from Robert Patterson/Pattinson (Twilight).  Their number on caller ID showed as anonymous and 20855790316. VERY heavy accent and difficult to understand.  Phone calls had also taken place last December.  I returned the phone call today and stated that I knew nothing about what they referenced, but researched the telephone number and had reported it to the Ohio Attorney General similar to what had happened in Kansas and other states.  "Robert" responded with a thank you and hung up on me.

I got a few calls like this over the past year or so.  The most recent was yesterday.  The had my address and work number and the last 4 of my account number.  They said I took a payday loan in Feb 09 for $300 and with fees it was $5,400 or 6 months and 22 days in jail.  I never had this account in Feb 09 and they could not give the rest of the acct number to me.  They asked for my attorney name so I decided to have some fun.  I gave them the name "Harry Scrotum" and offered a phone number.  Doug was his name and said he would look it up on line.  I wished him luck and hung up.  This is an on-going scam and has been reported in several states.

I just received a phone call from a man with a very thick accent also...his name was Adam Jackson and said a law suit had been filed against me and he wanted my attorney's name. I hung up on him and he called back and left the very same message. Then he called my work number and left same message, threatening but not willing to tell the person who he worked for. The 805 number is identified as a cell phone registered to 01 Communications, Inc....what else could I have done? This must be another scam from payday loan advance companies as they are the only ones that could know that info.

I just received two phone calls from this number...I did a reverse search and found it to be a cell phone registered to a company named 01 Communications, Inc....who are they? He said his name was Adam Jackson...terrible thick accent. He threatened me with suffering from the situation as it would unfold...He said there had been a lawsuit filed against me and they wanted my attorney's name and address so they could contact him but refused to tell me what that action was about.
I hung up on him and he called my cell, leaving a threatening message, then called my work, leaving same message. There is no lawsuit that I know of filed against me for any reason.

I received a phone message as well, and everything I have read about other people getting calls from this person, is very familiar.  I have been given 2 names by this person, Adam Jensen, and James Connor.  He has caller ID too, because when I continues multiple times to return his call, I finally got through to him, and he said he'd call me right back.  He was very threatening, told me he was giving me a warning message, and that if I or my attorney did not give him a call back the second we received the message, the he was forwarning me and good luck.  Everytime I have tried to call him back, I either get a message stating that his voicemail box is full, or he disconnects me.  I have no idea how to stop this unless I get my phone number changed AGAIN!!

    Tired of this Adam Jackson
I received two phone calls today - one on my cell shown as "unavailable" and at my office direct line, wih no number. He has a horribly thick accent yet a very USA name Adam Jackson. He tells me I have a lawsuit filed against me and he needs my attorney's name and if I don't call that he wishes me best as the situation unfolds. He says it is time sensitive....sadly I have used Payday loans...and never had this happen before.  They have been repaid on time with no issues until now. He doesn't identify who he is with, refuses to but in a reverse search I found it is a phone registered to 01 Communications, Inc...their website is very vague with no phone numbers to reach them, no clarity as to who they are or what they do...

I also received a call from "Nancy Jones" who sounded very foreign and who also told me that she "wished luck on me if I didn't return the call and the courts would be contacting me if I didn't have my attorney call".  Thank God for the internet and the ability to research scams.

Today's phone call was very threatening, of course I didn't answer my cell when I saw it said UNAVAILABLE.  "Adam Jackson" said he was now making the last phone call until my case is downloaded to the courthouse and I have thousands in fines to pay or get carried away to jail. He insists I call that 805 number and tell him my attorney of record. He then repeats my home address correctly, obviously got information from an application on file. But I'm not calling him back, ever, as I have absolutely no reason a lawsuit would be filed against me. Frankly, he'd be more believable with a different voice, he's so hard to understand....lol
