- BigA replies to ben| 2 repliesHow do you know that the number is spoofed. Did you try to call them back at this number? The TCPA does not address number spoofing. It would only apply to the FDCPA if the number did not connect to them. It might then be a possible violation of 15 USC §1692(d)(6) Meaningful Disclosure.
- BigAYou will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it. It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Fits a pattern of spoofed numbers that robocall me in which the exchange part of my personal phone appears as part of the spoof number.

- Ian Moone| 1 replyThis is a valid number and I was able to verify the number and that it is indeed State Collection Agency. For me, it is a valid debt from St. Luke's Hospital in the Kansas City, Mo area. The debt was turned over from St. Luke's to State Collection Agency even though I was paying on the account. The account was turned over because I didn't agree to St. Luke's Payment Plan even though I was paying on the account. Technicalities, technicalities. My problem with this company is that the caller did not identify themselves upfront as State Collection Agency. Instead I was prompted with a 'live" person telling me this is "make up a name" on a recorded line. Is this "make up a name". And then asked me to provide details about where I lived, etc. Sorry, but you called me and I'm not giving out those details. If you want my personal details, Google me. Don't use the HIPPA, PHI and PII crap on me and you need to verify who I am.

None of which apply to debt collection. The FDCPA which does specifies that they must make sure that they are talking to the alleged debtor and not some third party.
