- Anna Griffin| 3 repliesA Lady named "Rosa" called, stating that CitiBank had hired them for collection of a c.c. debt from an account that was closed in 2008. This account (I thought) was included in a bankruptcy, but she assured me that if it was, she would not have been calling me. She even told me the correct amount that it was at the time (in 2008), and what month and year payments stopped being made on the card. She also said that somebody was going to be at my house to serve my husband today, unless we settled this thing right now, over the phone. The other option was they were going to garnish my husband's wages.Yes, a red flag was raised for me, but when she said we can settle for about 1/10th of what the debt was right now, I just wanted to be done with it. I did fall for this, and gave her my bank acct. & s.s.# for immediate withdrawl of funds. But something has been nagging me on this, because in all these years, I never once received a letter of collection from the creditor. So, I tried finding the address for this B & L Litigation, and this is where it led me. How do I recover the money they already stole from me, and does this mean I have to close my bank account and open a new one??? HELP!

- Anna Griffin replies to glorzillaThanks, glorzilla. Will be going to the bank as soon as it opens.
- BigA replies to Anna GriffinThe first thing you should have done is contact your bankruptcy attorney and let him handle this. That is what you paid him for. Now you need to file a fraud dispute on that payment with the bank. You will also need to reporte that your SS# has been compromised to the IRS. Also, file complaints on these criminals at the proper agencies. Everything you need to know follows:
This is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. One of the tricks they use is to call your work place repeatedly in an attempt to shame you into paying. They also use the “process server” who calls and claims he is going to serve you, but then says you could avoid it by calling another number.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.
If you feel you SSN has been compromised, in addition to putting a fraud alert at the 3 credit bureaus, you may want to notify the IRS. Here is the link, fill out the proper form (probably 14039):

- CWG40 replies to Anna GriffinYes! Close out any financial account number information you have them. Do it NOW! Notify your bank of possible fraud. Request the bank or credit card company to reverse the transaction for fraud. Do not pay them any money or agree to. This is most likely a debt collection scam. Pull out your bankruptcy decree and make sure the debt (if any) was included in the decree of bankruptcy. Read the other notes.
Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.
Report them:

- EmmaI received first a call from and "UNKNOWN" number, telling me that they were hired simply to schedule a day to have documents delivered for my signature. I refused to give my address to this female, so she gave me a number and "reference" number I can use to find out what it was about.
So I called the (844) 287-9789 . A "operator" answered and asked whom I was calling for that she could transfer me to, because there are several attorneys in the building. Asked for my name.
I gave my first only, some "Paralegal" answered told me a summons had been issued and I was to sign for it, that one had been delivered 60 days ago to my old address, she knew the last 4 of my social and a phone I had purchased and quit paying on because the company scammed me with a refurb, continued to tell me they would garnish my wages, and my tax return etc. would be attached and the female was so aggressive and kept telling me "this is not personal she is JUST a paralegal" however I asked her if you're JUST a paralegal you're getting awfully aggressive, can you call me back I have to get back to work? She then said, "they'd be at m y job in 30 minutes JUST SIGN FOR THE DOCUMENTS!!!" I told her that I had to get back to work-she flipped her lid began yelling at me and telling me that's it, you're on your own, put me on hold after yelling at me repeated that if she's JUST a paralegal she's awfully aggressive.
Then after 30 seconds on hold I hung up.
This crap is SOOOOOO not ok!
How did she have so much personal info on me!!!
BE FOREWARNED!!!! this was two separate calls, these were females, and the process up to the aggression seemed legit (slightly) I fell for it for a few minutes-I'm always battling my ex-husband over custody.- Caller: B & L

How can I verify whether or not a debt collector is legitimate?
Here are a few warning signs that could signal a debt collection scam:
The debt collector threatens you. Legitimate debt collectors probably won't claim that they'll have you arrested or claim that they or their employees are law enforcement officers.
The debt collector refuses to give you information about your debt or is trying to collect a debt you do not recognize. You have certain rights to ask a debt collector to verify the debt. You can use this sample letter to request this information. Ask for an explanation in writing before you pay.
The debt collector refuses to give you a mailing address or phone number.
The debt collector asks you for sensitive personal financial information. You should never provide anyone with your personal financial information unless you are sure they're legitimate.
If you think that a caller may be a fake debt collector:
Ask the caller for his or her name, company, street address, telephone number, and professional license number. Many states require debt collectors to be licensed. Check the information the caller provides you with your state officials, or the state in which the debt collector holds a license. If the caller refuses or is unable to provide you with information about his company, or if you can’t verify the information he provides, do not give money to the caller or company.
Tell the caller that you refuse to discuss any debt until you get a written "validation notice." This notice must include:
The amount of the debt
The name of the creditor you owe
A description of certain rights under the federal Fair Debt Collection Practices Act
If a caller refuses to give you all of this information, consider requesting this information in writing or seeking assistance before paying the debt to make sure the debt, and the company, are valid.
Tip: You can consider sending the collector a letter requesting the information by using one of the CFPB's sample letters. You can also submit a complaint to the CFPB or you can contact your state Attorney General’s office.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know the company or person you are talking with is a real debt collector. Scam artists, like fake debt collectors, can use your information to commit identity theft such as:
Charging your existing credit cards
Opening new credit card or checking accounts
Writing fraudulent checks
Taking out loans in your name
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Submit a complaint with the CFPB or get in touch with your state Attorney General's office with information about suspicious callers.
Stop speaking with the caller. If nothing else works and you believe the calls are fraudulent, send a letter demanding that the caller stop contacting you, and keep a copy for your files.
Tip: You can use this sample letter to write a letter demanding the debt collector stop contacting you. By law, real debt collectors must stop calling you if you ask them to in writing.
Tip: If you're having trouble with debt collection, you can submit a complaint with the CFPB online or by calling (855) 411-CFPB (2372).

It would be very easy for any lawyer to identify who it is you intend to sue. Document every contact you have with them. Record the calls if your jurisdiction allows it and exercise your rights. - Wasnt born yesterdaySCAM !!!!!!!!!!!!!! do you research people!!!!
