I was contacted by a woman from the 'legal services dept of texas' who said im supposed to be served with court papers between 11am & 1pm at my residence or place of employment & i could barely understand her at all. I think she was either foreign, [***] or on drugs. Gave case number of 749018 and telephone number to call her back... strange thing is that she must've thought she had disconnected the phone call because she was on the phone long after she stopped talking. I called back and the same woman answered and said they were 'filings & claims inc' and even said that she had just called me. Wouldn't tell me what it was about. I even asked if it was collections (because I owe a few loans and would be happy to repay it)... but kept asking for my ssn.

Got a call from a woman claiming to be with Tennessee legal department. Said I must contact them as I am being charged with fraud. Fraud for what I have no clue as far as I know all my bills are up to date. When asked what this was about she gave me a number to call that was the supposed filing claimant, the number came back to her again. When asked to send me a bill she said she will send sheriff's to arrest me, and that would be my proof of bill. Weather I have an outstanding bill or not it is illegal to threaten someone with arrest, jail over bills. Bills are a civil matter not a legal matter.
I believe this is a scam. I should know I am a victim of this same scam in 2013 someone threatened me with arrest if I did not pay 1,500 that day. My dumb ass panicked without doing research and paid. Not again.

Also said June 4 was my deadline/serve date.
I'm noticing a pattern on the date which tells me it is a scam. Why is everyone in several different states getting the same date? Perhaps that is when they change names, numbers, etc to avoid being caught.

Extortion Scam Related to Delinquent Payday Loans

    Washington, D.C.
December 07, 2010  FBI National Press Office
    (202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    A Collection Agent May Not…

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

    Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

    Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I received a similar voicemail today from a Heather Lutz claiming to be from the "State of California Legal Support and Servicing Department". Stated something about fraud and that they will be filing a legal case in 2 days in the my county of residence. They even went as far as stating my social security number on the message. Although she tried her best to sound like a lawyer or clerk, from reading other responses this is most likely a debt collector violating the The Fair Debt Collection Practices Act. Specifically:

    (1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.

    (3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.

    (4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.

    (5) The threat to take any action that cannot legally be taken or that is not intended to be taken.

The little tidbit at the end when she says "At this time you have been legally notified. I wish you the best of luck."

I'm pretty sure you can't get "served" over the phone, let alone voicemail.

If this is legitimate, then I'll wait for the actual legal papers and pay up. I'll update this then.

I got THIS SAME exact voicemail just yesterday. However, the guy who contacted me is named Michael Bauer and stated that he was with the State of Texas  Legal Support and Servicing Department. He too said, "At this time you have been legally notified. I wish you the best of luck." He called from an unknown number, which is why I didn't answer. I am supposed to get "served" today at the address listed. He also stated my last four digits of my SS#.  He did leave a 1-844 # to call back, but he didn't give me the full preceding numbers.

Got the same call as other shown above, gave the last 4 digits of my SSN and told me I was being charged with 2 counts of fraud, and gave me the 844-506-6288 number, I didn't call that number, I Google searched the number and got this website with all this information, I tried searching the civil and criminal cases in my state of Virginia and that case # wasn't accurate.

And I have received the exact same voice mail from a Salvatore SomethingOrTheOther.  I am by no means without a few problems in my past, so I did a search for the "Texas Legal Support and Servicing Department", thinking I would find out what the issue was and see what kind of arrangements could be made.  What was really suspicious was the address he kept referencing - it was an old address of mine where I had lived years ago.  If it was truly the State of Texas, they would know EXACTLY where I live, right now.  So when I was unable to locate any state agency with that name, I did a search for the phone # and found all of these complaints.  I agree with all of y'all:  if there really is something to this, they will find me in due time.

This article is on a radio talk show website today,

Victims say phone scammer claims to be with Sheriff's office

LEE'S SUMMIT, Mo. - Victims say a phone scammer is claiming to be with the Jackson County Sheriff's office.

Authorities found out about the most recent phone scam when the victims called them. The victims said a male caller identified himself as a captain with the Jackson County Sheriff’s Office.

The caller told the victims they had a warrant for their arrest, but that if they called a certain number they could make it all go away. Authorities are reminding people that all payment of fees and fines is conducted in person.

If you get a call like this, you're asked to call authorities.
