I am so shock reading all of this, I did not even know this was all a scam. They had been taking out money from my account since April this year. I’m not sure of her name, but she called every family members of mines. Saying that they had a lawsuit against me that I did not even know about. So when they called me, they said I had an open credit card with Capital One. Mind you I don’t recall this credit card from 2006. So she tells me, they have a lawsuit n if I don’t pay this amount they will be taking me to court. I’m like I don’t remember, n she said well you do and if they don’t get resolved we will go further with this in court.

So she tells me that I am better off paying my debt off, instead of taking it to court. She said it will cost me more. Now I am broke n a single mother, just trying to make it in this world we call the Land of the free. So, ofc I don’t have the funds to be fighting this in court. So I agreed I’ll pay the minimum amount. So, we came to an agreement of $83.64. That’s all I was able to pay a month. I mean not really but I guess.

Anyways, how do I go further with this situation. Cause this mama can’t afford to be scammed. Please help any advice.

There posts on page 2 in this thread from BigA and CWG40 that may be of help. Some of that info might need to be updated, but the process is correct. Remember:

    Quote:
Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.
If they are bothering you, report them:

http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening civil proceedings with no intent to follow through, or threatening criminal process in order to collect a civil debt is a  violation of the Federal Fair Debt Collection Practices Act.)  The same goes for endless telephone harassment

Also contact your local attorney general

If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

You'll probably have to yell at them and talk over them.
You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking),  the only thing they understand.

You are dealing with some long-time criminals who are experienced at lies, threats and manipulation. They often target the elderly and single moms.

The next time they call, let them know they are being recorded (legal in most states), and demand the legitimate name of their company and mailing address in which to send a debt validation letter VIA certified mail with return receipt request. If they refuse, let them know your attorney will get this information for you and hang up.
