Paralegal Bruce Cutler threatened to issue a Warrant.

Total scam.   Only judges issue warrants.  Stupid scam.  Who'd fall for it?

Scary voicemail if I didn't know my rights.  Can't figure out what number it came from, I am assuming the only "private" number on my caller ID. However this number was left as the call back number.

Anyway, the summary of the call (not word for word) was from a Mike S... from Regional Express Carriers,  which is a process server retained by the City of <my city of residence> and he has been retained by Shapiro and Associates and that the call was my state mandated notice of intent before he serves me at my home or work.  I can still settle this out of court, and should call them at 8447957493 with refernce #. If I do take care of the matter make sure that someone notifies him of the Stop Order Request.

I know this is fake, funny how someone else had almost the same voicemail left... but I did do some due diligence on my end. I may need this later when I file my CFPB complaint.

1. Toll free number search yielded nada, hence my post. Upon calling it back I got a generic voicemail message, no company name given. Hmmm... professional law firm? Don't think so.

2. Looked up this law firm Shapiro and Associates,  apparently a popular law firm name shared by many firms. Coincidence?   A lot of debt collectors do this on purpose.

3. Looked up business entity search for "regional express," "regional carriers," and "regional" in my state. (Process servers need to be licensed in my state). Lots of businesses under regional,  but nothing under the first two searches.

4. Looked up business entity search on shapiro, and let's say there's a lot. Again... license needed.

5. Looked up court filings against me. And nothing there that has been filed. Hmmm? How can I be served if a case has not been filed? Let's just say this "process server" works backwards from other real ones....

6. Needless to say, my state does not require or "mandate" notice of intent to file a lawsuit.

If you receive a call like this it is fake and violation of the FDCPA on a number of levels, and possibly a violation of state laws.

I will do some more due diligence,  because I am curious about what I am going to have served to me... haha haha

Some guy name Mike claiming to be from a law office has been blowing up my phone saying they have paperwork pending to garnish wages and to file criminal charges againsnt me wth...smh

Finally decided to eat lunch offsite and called the number back during business hours. I got hung up on, and then he stopped hanging up and refused to talk to me... (seriously, and I was being nice, or uh trying to). I made some headway at first because I played dumb a bit.

Definitely a scam!  If I get sued, I'll come back to this post saying that I was "wrong."  But due to a bad financial hit in my life in the past (choosing to take unpaid leave from work to care for an ill family member, and then choosing to pay my high priority bills first) I have been sued before, this whole scenario is not even close to how it happens.

Mr. Bruce Cutler, a paralegal, from Shapiro and Associates located in <MY CITY>, NV is the person I talked to.  I have two pending cases against me in reference to a payday loan company:  Evergreen Riverside Payday loans.
     1. Intent to defraud a financial institution
     2. Criminal bad check charges

Oy!  Let's just start with I don't ever recall having a loan from this Evergreen company, I'll just list the red flags.

1. Refused to give me a mailing address, email, website, etc.  Only said that they are in <My city> NV.
2. Told me to get my debt validation I had to contact the original creditor, and gave me a website and phone number.
---------- the website evergreenpaydayloan.com is a lead generating site, not a funder.  (or so their site says).  The phone number yields nothing in searches.
3. He hung up on me twice, and then flat out refused to give me more information like repeating the charges against me.
4. Stated that the call was a on a recorded line on the 3rd call.... oh ya?  Well if you really are a Law Firm in Nevada, then you would know that Nevada is a state requiring both party notification!
5. His advice to me was to call Evergreen and get the debt validation from them.  He is not a collection agency, they don't take money.  HA!!!  Sure you don't.
6.  If he really was with a law firm from Nevada he would know the following:
      A.  Payday lenders have to be licensed (so do law firms, and oh so do process servers)... I can ask for a business license number at any time
    B.  Nevada does not allow for criminal bad check charges for payday loans, and with online lenders there is no check.
     C.  Intent to defraud a financial institution?  Not worth the comment.

I got a call from these bottom feeders today. Okay, to sue me they have to send me a verification of debt. As a general rule, the police serve papers in my state. I am in bankruptcy, so the debt is almost discharged--5 months left--to sue me the judge must sign an order allowing them to sue me--my debts are listed, so they are screwed. Essentially, short of me being brain dead--they would have a long and difficult if not impossible legal set of hurdles. Can't wait for discharge. :-)  

I keep getting calls from this number and I've called it back and I talked to Bruce Cutler and they are stating i owe this money and how they are going to issue a warrant and charge me with all of this stuff.  I've asked for them to mail me something and i've been told they dont need to.  I've been crying because these people are scaring me and i have 3 children.  They said they have my license plate number and will come to my place of employment.  I don't know what to do can someone PLEASE help me  

They are simply attempting to scare you. They do not have the authority to do anything they claim that they can do. It's a collection agency; most likely from a payday loan company

It's a debt collector scam.  Ignore 'em.  Only judges issues warrants and that is only on the recommendation of law enforcement officials and only in criminal matters.  Civil debts are not criminal matters.    No judge issues a warrant in favor of a debt collector.  Period.  Yes, they have to mail you a statement of the debt with all the particulars.  It must be by US mail.  e-mail no good.   Don't let 'em scare you with worthless legal terms like warrants and jailtime and all that other crud.  

No process server gives you warnings of showing up.  They just show up.  These are scammers pure and simple.  

Go to police and make a complaint.  Also make a complaint to local attorney general.

A lot of these debt scammers both here in the US and overseas like to pick on single women, single mothers, the elderly and members of the immigrant community.  They are looking for vulnerable ivictims.  

They call again, tell 'em to go to hell!  Do it loudly.  Tell 'em you know it's a scam.  Talk over 'em if they give you trouble.  Make a complaint  to the FTC.

This may be the company in question.   Google street view shows it in a neighborhood or more or less run down houses and commercial establishments.  

Perfect neighborhood for a debt scammer.

Caller does not identify nature of his business but sais he has a file in his office with your name and phone number, wanting you to call back... Harassing phone calls

Update: another call today threatening me with dire consequences if I did not resolve this issue. FYI: Be careful and make all court dates. In some states you can be detained with a "Body Attachment" which, is normally used in child support, or refusal to pay official fines. The bail is often the exact amount of money that you owe and is often turned over to the creditor. Other states see this as an abuse of the legal system to collect small debts. The latest article that I read stated that about 1/3 of all states could employ this technique. Watch your mail, and make all court dates.

I received a call today saying they were gonna come arrest . saying i owe an internet loan , both the persons I spoke to were very rude and hung up on me

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

Yes i imagine i was scam the same thing happen several years ago which i imagined it would be the same thing . the lady that called had an indian accent and was very rude , and called from a private number

How funny i received the same phone call with the same words .Scam

I received several calls from this number on my corporate Blackberry.  I think they must have an automatic dialer that dials numbers until they get a hit.  I called back and received and the call went to voice mail.  I'm hoping someone calls back.

They cannot threaten you with telling you that you are going to jail or that a warrant has been issued.  Google Fair Debt Collection Practices Act and read it.  Call them back (leave a voicemail if necessary), tell them you have contacted the attorney general in your area and reported them becasue you know they are a scam collection agency/attorney office.  It is not against the law to be in debt and they are not to act as if they are part of the court system. Period!

This guy has called "foaming at the mouth"... my words, trying to collect debt from my brother. He IS threatening me, saying that he works for Shapiro and associates, whom I have contacted, WHOM says he does not work for AND that there have been numerous complaints, via google,from this number.....

He will not return my phone calls to him to find out who he really works for. I have been recording, to his knowledge , all phone calls, yet will not return them...

I encourage any and all offended people to continue calling 844-795-7493 repeatedly for Robert Night "so he claims to be" until some one gets an answer where or if he really works for someone...

Heh, thank you for this. I didn't even bother calling back cuz I knew it was BS and I know my rights...  But I really wanted to know what they'd say if I DID call back... This made my day
