- Alfalfa replies to GregThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

The people telling you this are basically extortionists. Ignore them. Proper service of process is in hand. Not some crazy scammer trying to trick you over the phone. How about you just calling up the local courthouse and checking out the active civil defendants list?

These people go around shotgunning every phone number they can where the owner's name is close to the phony debt paper they have. And then just call them until somebody is fooled into giving them money. No one knows where they are really located. They've used IDs such as Statewide Solutions, State-to-State processing. Statewide Recovery and a variety of different names all with the word "state" in them. Total scam outfit.

One thing I was wondering about you "Megan";--how are you paid for this job you do? Do they pay you off the books? Do they just give you some cash at the end of the week? You get paid a portion of the money you scam? Are you a formal employee, or an independent contractor? You work out of your house, or are you in the second floor of some grungy office building in some run-down town. Possibly in New York.
I wonder. Are you are up on your income taxes? If they are paying you in cash I bet you're not reporting it.
By the way, I haven't found you yet, but I'm working on it. You gangs of white-collar criminals think you're bullet proof. Remember, VOIP and Magic Jack aren't 100 percent perfect. You people always make some kind of mistake.

They claim it might be another company. I keep sending them a paid in full letter, they claim they haven't Recieved it. But they are so sure the account numbers don't match. I swear they changed the numbers bc they are so close to each other. The company they claim I owe had disconnected all their numbers. Now their saying they are having me arrest. What do I do

- CWG40 replies to MattIgnore them. You can't be arrested for ordinary civil debt. They throw around a lot of legal terms and tell you there are warrants outstanding and that you're going to be arrested and a whole lot of other legal junk in order to scare you. I wouldn't talk to them any more. Do not pay them anything. Block their calls. Debt collectors have no powers of arrest. They have no influence on law enforcement. Criminal matters are handled by police and local district attorneys. Not some scummy debt collector. They are clearly trying to scare you. Don't fall for it! Fraudulent or Zombie Debt Collectors—Things to Know
If you have received a call stating:
1. You have defrauded a financial institution
2. You owe an unpaid payday loan
3. You have a warrant due to an unpaid loan
5. You will receive a court summons
6. Authorities are coming to arrest you
7. Anything similar to above,
a. Do not give them any information or verify any information for them
b. Tell them you know they are a scam operating illegally and that you are filing a complaint with the appropriate authorities
* File a complaint with the FBI on their Internet Crime webpage http://www.ic3.gov/default.aspx
* File a complaint with the Attorney General for the state you live in
The more information and complaints there are, the better the chance of getting these criminals to stop (or at least reduce the frequency).

- sabir| 2 repliesi got this call yesterday from a "Brianna Tamerano" from 855-292-7934 who said she was collecting this debt on behalf of Advance America, but she called my mom first, and my mom panicked and called me. i was livid for two reasons: one wtf you calling my sick mom for and two i'd already paid this money to another company. gave me some bogus account number and everything. if i get one more call like this about this, i'm going to track them down.
