    The dirtbags called your mother first, knowing all along how to reach you directly, to elicit exactly the panic and anxiety and false shame they need to coerce payment of bogus debt. Don't wait for another call. One FDCPA violation is enough to sue for relief.

    The person who owns the debt can go to court to try to get a judgment, but most of these debt collectors never go to court they rely on scare tactics to squeeze money out of people.   The debt collectors that go to court are the really big companies where they associate with attorneys in many states and file thousand upon thousands of cases.  The debt collectors of the big firms rely on quantity.   But, as I say, most of the smaller kitchen-table debt scammers rely on old debts of questionable validity and never go to court.

    Total garbage, there's no way a civil debt can be magically transformed into a criminal case.  You can't be arrested for ordinary civil debt.  

    In any event public prosecutors and police handle criminal matters, not some scummy debt collectors.  Prosecutors don't inform  debt collectors about anything and debt collectors have no influence on the criminal justice system.  This is just a ploy to scare you into paying them something.

    Block their calls.  Don't return the calls and don't talk to them.

    If they continue to bother you, tell them you know it's a scam and that you'll report them to the police for an extortion attempt.

    Then do it.   When you get the police report, and they call you, just read off the police report complaint number.  That should shut them down.  At least for awhile.

    Invest in a call blocker.

    Received a call from Private/No Caller ID # yesterday evening.  They called my phone 6 times before leaving a nasty message from some rude lady named Nicole Gross.  She stated she was calling about legal matters and needed to verify my info so I could be served with papers.  She pronounced my last name and my maiden last name wrong.  She sounded like she was trying to be tough and mean.  Said I had one chance to fix it, left a case # then again pronouncing my name wrong, said I was officially notified.  She called and left the same nasty message on my husband's cell phone.  I got to work this morning and she left a nasty message on the voicemail for my manager.  This stuff has got to stop.  These are scams and I am tired of it.  Yes, I stupidly took out payday loans in the past.  Yes I did default on some but have since paid them all back and probably paid back some more than once.  You better believe I will be "following up" with this b*tch that called and making sure they never call me again.

    Can you look up mine for me I can't find it anywhere  they called said I would served and go to jail freaked me out and I've been looking ever since to find my so called case and I just can't maybe you will have better luck than me. It would either be in tarrant or Dallas County courts case number would be 191931 well the number they gave me anyway

    It's a scam.  Threatening you with jail over a debt is a big no-no - debt is civil, not criminal.  Just call your local court houses to see if you're named - but know this - they'll tell you the same thing.  NO ONE gets a heads up they'll be served - the process server just shows up, unannounced.

    Call blocker is your best bet and do not pick up on call numbers you do not recognize.   This is your basic debt collection scam. No legitimate process server notifies you in advance they are going to serve you.  Do not return their calls.  Do not speak to them or give them any information.

    I keep the number of my state AG's Consumer Complaints Hotline on speed dial.  Any time I get a call from one of the scambags, I let them go through their spiel, ask them to hold on (while I "get a pen"), and do a conference call with the AG's number.  As soon as they hear "you have reached the office of Attorney General (name) Consumer Protection Division", they either hang up or go nuts and then hang up.  If they stay on the line long enough, I'll politely ask them to tell the AG's rep what they just told me when they come on the line....you know, "just to verify that this is legal".  I even put one who claimed they were calling from the AG's office on the phone with the AG's office.  You shoulda heard the F-bombs fly!  It was quite an entertaining few seconds.

    Even if you've paid back every loan you ever took out, the scambags now have your info, and they will just pass it around.  That's why you may get two calls from two totally separate collectors about a debt you paid off 5 years ago.  All they have is an "application" you submitted for a loan (if it's even a legal application, which most of them aren't).  They couldn't care less if it's a valid debt - they just want access to your bank account, usually for money-laundering purposes.

    I feel your pain.  I too made the payday-loan mistake, and although I paid each and every one of them off in full, the scambags just keep coming back around.  I'd like to tell you it will stop someday, but as long as they have your name and phone number, it'll just be passed from boiler room to boiler room.  Best thing to do is let them know they're wasting their time.  They'll eventually give up, and you'll get some relief until your info lands on the next scambag's desk.
