I just got the same call as you......is this a scam?

Of course it is a scam.

They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid. 

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I received a threatening phone call from this phone number. Stating that I owed Wells Fargo Bank over $2000.00
This account is over 10 years old. I never had an account with Wells Fargo Bank in 2008. I feel that this is a scam that they are trying to extort money from me, because when I asked for information, they refused to give me any statements about this so called account.

Omg I just got home to find this stupid message about someone making a complaint against me too and if I don’t respond legal matters or some [***] will be taken against me ufgghhh thank god I came and read all these comments

Laddy called me from un known number she said I must go to court and she gave me phone number 855 415 4876 to call and she gave me case number 556057 to verify my case number i am very sure it’s scam I told her to send it in the mail she said you must call first she has all my information name address and I don’t know what else

Received a voicemail requesting a call to 855-415-5840. Appears to be a scam.

Got a call from a "no caller ID" number with a message claiming I was served at my property but they couldn't get a signature, etc. I'm at work when this happened. These people are crazy and I do not owe them a thing! Report this number!

Called twice from private #...left 2 identical BMW stating there was "action pending" against me. Very vague - did not fall for it.  Certainly this is a SCAM...BEWARE!

Problem:
This “law firm” has been calling myself as well as 3 of my family members regarding an issue and person that are in no way linked to me. They call from a phone from phone numbers alike, with a variation of last four digits. While leaving messages for myself and leaving messages for my family members, threatening law suits, federal law issues, warrants and arrest threats, I have called this office myself as well as speaking with their “call center” to let them know, I am not the person they are trying to contact. In doing so, I’ve been hung up on, cursed at, told “I don’t listen well, have rainbows shooting out of your ***** Absolutely no professionalism, harassment, worst part is they have been notified on several occasions they have the wrong person, they have the knowledge, which is on recording and the actual person will not be obtaining the documents which will likely turn into a federal suit, as this firm has stated. With this knowledge this form is not following legalities regarding myself or this other person. I was not aware any reputable law firm would ever conduct business in this manner. This other person is not justly being contacted or provided the information, per law, as she should be.
