    New Variation on Telephone Collection Scam Related to Delinquent Payday Loans

    02/21/12—The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.

    Callers pose as representatives of the FBI, “Federal Legislative Department,” various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim’s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.

    The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim’s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it’s the latter, the caller tells the victim that he or she is wanted for hacking into a business’ computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.

    The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim’s job. In another instance, a phony process server came to a victim’s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.

    If you are contacted by someone who is trying to collect a debt that you do not owe, you should:

    ■Contact your local law enforcement agencies if you feel you are in immediate danger;
    ■Contact your bank(s) and credit card companies;
    ■Contact the three major credit bureaus and request an alert be put on your file;
    ■If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
    ■File a complaint at www.IC3.gov.

    they are a scam, they called my phone looking for someone else, and when i gave them my name to prove i wasnt, they told me now they would put that debt in my name, i told them good luck. please report them. and what ever you do DO NOT PAY THEM OR GIVE THEM YOUR INFORMATION!!!

    Kimberly next time she calls, tell her first that having an "affidavit" means Jack [***], and that if she wants to continue trying to scam decent hardworking Americans out of money she should brush up on her legal jargon. Ace Cash Express handles almost all collection from inside the company. It costs TOO much money to outsource and the payday scumbags like their money too much to pay outside bottom feeders. My advice, download some kind of call blocker. If you cant, get creative and call her 50 times in a row and just hang up when she answers. Then get a whistle, blow it in her ear when she answers. As soon as you hang up - call her again to see if she answers, if she doesnt you should be good. If she does answer, blow it again and repeat until the dog learns. Dont let them scare you, that is what it is all about - intimidation. Be a [***]! She is threatening you, get pissed and deal with it.

    Frustrated with all this
    I received a call from a woman named Diane Wilson stating that I am being investigated and a warrant being issued for my arrest over a three year old payday loan. When I called her back I was transferred a supposedly lawyer who at first said he cannot do anything for because this situation has gone to warrant status, BUT then put me on hold to check something. He came back to the line and started talking about I got a payday loan and they have me video surveillance and so forth. He said that I would need to make a payment in the amt of 1610.00 to stop the warrant process. I asked so you said the warrant was already issued but now you are telling me that it has not been issued. He said no and asked if I had the money to pay, I told him yes so that he would move forward. He then transferred me to his assistant Ms. Campbell, I asked what the name of this company was, she said The Law office of Mediation and Arbitration in Dallas and the telephone number is 9729687218. She proceeded to give me Money gram information  that entailed me using the BLUE and WHITE express form and to put the receipt code #7031 at the bottom and to write the company name VANTAGE POINT SERVICES. I asked for verification in writing of this debt be faxed to me before any monies is sent to anyone and this woman told me to get the info from some processing place after a payment is made and that is all she would give and said that we are not a collection agency and we don't just sit around writing letters demanding payments from people!!!!! I told her I did not say that but I do feel that you all are a scam and I need written proof provided to me or there will be no monies sent to anyone. She said I would get documents once I make payment of my restitution then forms will be emailed to me.    I AM SO SICK OF THESE HORRIBLE PEOPLE CALLING AND HARASSING AND DISRUPTING PEOPLES LIVES WITH THIS UNETHICAL MESS AND THREATS OF WARRANTS AND JAIL!!!!!!

    Not every body who falls for their lies is an idiot. These people know exactly what to say to scare people. Being ignorant of the law is not being stupid. And FYI [***], I have a paralegal degree and I believed it because I was going through a million other stressful things at the time. I think you are the idiot because you clearly have no idea how humans behave

    Of course people know whether or not they have a debt.  But,  here's the thing.  The question is not whether a debt is owed or not.   The question is "do you have the cajones,  and the legal right to claim and collect in court". It's up to you to prove that it is legally collectable, by you and in that state.   If you can't validate,  you don't collect....

    kc replies to AMAZED
    No you don't.  Your jaws get tight and you come on a board like this and pump your BS trying to boost you chances of collecting.   Otherwise,  you'd be back on those phones shaking down grandma out of her social security and little Jimmy out of his lunch money.
