- CWG40 replies to Ketha| 4 repliesNot an attorney's firm. Callers are debt collectors. If you call that number they ID themselves as "Daniels and Associates". Guy I talked to said they were a "litigation firm" . Which is total nonsense. In order to litigate you have to be a member of the state bar. And this guy said they were not an attorney's firm. Anyone who tells you they are calling on behalf of a "litigation firm" is basically a debt collector trying to scare or scam you. Simply ignore and block the calls.

Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question. As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes. The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question. Most do not send debt validation letters and many often say they are collecting for someone else. So, make the complaint anyway if they are bothering you. Let the FTC sort it out.
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them. Tell 'em no scammy debt collector is going to push you around.

If you were the subject of a pending civil lawsuit, you'd have received a letter from the specific attorney for the other party. You'd have a paper trail.
Then, if a case was filed, you'd have received a summons delivered to you by someone licensed to serve process in your locality. You would NOT have first heard about any civil law case from some scammery-scummery debt collector who cold calls you and starts demanding money.
You can check this out yourself by simply going down to the local main civil court and checking the defendants civil list. The court clerks are usually glad to help and are familiar with these kinds of scams.

Said they were a large office and handle cases across the country. Kept demanding my name or case number kept telling him they're talking too fast can't understand. Got real snotty with me when I asked questions then hung up on me when I said you're a scam artist and I'm going to report you to my attorney general.

- BelleThis phone number which came up as unknown on our phones called my mom, brother, and me trying to get ahold of my other brother. So finally my brother called them and they were demanding money. He pretty much told them it wasn’t going to happen then they started threatening him that they will take him to court. Once he told them they were going to spend thousands of dollars on court fees for 40 dollars they started getting mad so my brother hung up and blocked the number.

- Jeba12I first received a call from a blocked caller asking for my husband. She said she was a private process server trying to serve him with a civil suit. She said this was the third attempt and they would like to set up a time to serve him. She gave me the number to the lawyer and file number. When my husband called it was Adams Daniels and associates and they claimed that he owed $678 for a citi bank card that was not paid from the year 2000. They said with attorneys fees and interest over the yrs he owed almost $3k and they were taking him to court. When he asked for the actual attorneys name and California bar license number the guy hung up. I will say this is definitely the most elaborate scam we’ve experienced...

They said it was for a bill from 17 years ago. I do not owe it. It is about 200.00 and I first found out about it from another company. I told them it was incorrect and to please stop calling me. They did and now I get a call from these people who say they are going to sue me and to expect a processor and even gave me a case number! - JessicaJust had this happen to me almost gave me a heard attack.. these people should be ashamed of themselves same name but the number to call back was 1 855 351 8816 .. When I told him screw it I'll just go to court see you there cause I know I don't owe any medical bills, I've always been covered. He got pissed off and told me it would add up in court cost and fines around 3k and I just said okay see you then and he started going on about how I can pay 800$ now to avoid court and I said no I'll stick with 3k and said bye and when I was hanging up he started saying something like "you'll be sorry..something something " click.

- DebbieYesterday from someone giving me the attorney's phone number to verify information. The lady on the phone told me they had had two undeliverable pieces of mail sent to me that were returned. I told her since the attorney contacted them to have the attorney contact me but I would not provide her any information. Within 30 minutes they had contacted my mother-in-law my father-in-law and my brother-in-law and gave the phone number and a case number and ask for me to return their phone call. The first person I talked to by the name of Franklin Parker explain it was over a $5,000 worth of unpaid medical bills and it was in my previous last name which I have not been in over 12 years. Said I might be able to do a settlement for 2940. Told me to call back after 4 with a counter-offer when I did didn't even take it to anyone else told me possibly the hardship Department can help me transfer me to them. I talked to a man named Ian O'Donald who told me with 10% down $508.26 we could get it into a hardship that they would need to send me something via email the settlement Arrangement agreement for me to sign and return to them via email and then start asking me for my credit or debit card information said it would not be pulled from my banking account information. Ask me if I had the card with Missy to go ahead and enter it and I told him I had the card but I would not provide information until after I got paperwork from him and I made some phone calls to look into this. I asked numerous times to get something to validate these bills he was speaking of he told me he could not provide that for me I asked for the direct phone number of the company that was supposedly suing me which again he refused to give me and said it would be a conflict of interest because the party suing me was their client not me. After speaking to my father-in-law and tell him everything that was said my father-in-law told me not to worry about it it sounded like a scam therefore I haven't even opened the email that was sent to me yesterday. So I decided today to look up this law firms name and like many others of you I found all this information. It looks like this spam starting somewhere in the middle of December and thank everyone for posting your information I will be reporting them and contacting the local State Attorney General

- QueenBThese clowns contacted my ex sister in law instead of me. The message was relayed to me, so I called. The guy I spoke to claimed that I owed money from 2002. He was very vague, talked fast and refused to provide any information that I asked for. He was rude, forceful and very demanding. I was blindsided! He said a summons was being served the next day, but if I sent him the money by close of business that day, he could make everything go away. He wanted my credit card or debit card number and said he would email a form for me to sign, giving my consent for him to take the money from my account. Threatened me with court too. Thank God I was given information about this comment section! I called the county clerk and there were no judgements or claims, and there wasn't any summons being served. I could go on and on, but I think it's safe to say that this is truly a scam! Don't fall for it!
