    These people called my phone and left a message for me to call them by the end of the business day at 10:15 by 11:00 they had called my Mother in Law, my husband, and his ex wife saying I was in serious legal trouble. I was threaten with wage garnishment and sending papers to my district. They refuse to provide me with written proof of debt. They have said for 2 days they will email me with info but have not. I believe this is a scam but how do you really know. I have an ex that was on drugs and did take out some payday loans in my name but I thought I had paid them all back. The "scammers" did provide me with a company, an amount  and an account number verbally but nothing in writing.

    There are no criminal charges tied to civil debt.  Furthermore, wage garnishment can only happen after they have served you and you go before a Judge and are allowed to present a defense.  They would have to win the case before being allowed to garnish wages, and that would only happen if it was allowed by state law.  Now carefully read the following and use the links to further educate yourself so that you will no longer be a victim  of this criminal activity:
    This is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this,  all for an alleged or nonexistent debt.
    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    Thank you BigA. Luckily I I did not give them any info. I did as you suggested and when they called back I told them they were legally required to provide me in writing my debt. The were legally not allowed to call my friends and family so until I received the letter of proof that I had nothing further to say to them. I have been almost 2 days with no harassing phone calls. Can't thank you enough for your advice.

    You are very welcome.  They have no power over you if you know what your rights are.  Their whole scheme is dependent upon people not knowing and then they can scare them into paying, which of course is extortion.

    The DA office only handles felonies. (Except Bad Checks) I owed 632.48 and I just simply took care of it in which I do remember my brother taking a loan out in my name which he is in prison at the moment. Look people everyone can go back and forth about what this and that is however the bottom line is I'm not a fraud and if you owe a bill, debt, loan, or whatever it is just take care of it. Everyone likes to look for a way out of their situation any excuse not to handle their affairs I know because I was that guy until I met Jesus and he changed my life! Lol pay your Bills and you wont have a problem everything else is irrelevant. Good Day Folks!

    I agree that you should pay your bills. The ones you actually owe. The people that called me stopped the threats, the calls and everything as soon as I asked for proof of debt.  Knock on wood I have not received any calls in a few days.

    For Extortion Scam Operations,  File reports with the FBI, your state attorney general and Department Of Justice,CFB,FTC & FCC..  Emails can be attached to complaints filed with IC3, the cyber crimes division of the FBI.

    Extortion Scam Related to Delinquent Payday Loans

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    I just wanted to let you know that these people have stopped calling and I have yet to be arrested, sued or my wages have not been garnished. Nor have I received proof of debt. Please do not fall for their fake tactics.
