I received a call from an Investigator Carter saying he is from Kennedy & Cline.  He told me that I need to contact a criminal attorney because his client is going to charged me with criminal charges if I don't pay a debt that I filed bankruptcy on back in 2012.  He told me that it doesn't matter that I filed bankruptcy they can still come after me and file criminal charges against me. They are calling me at work and harassing me.  I don't know how to get them to stop calling me at work.  Does anybody have any suggestions?

I've been going through this for a long time now...they stop for months then start up again with a new company!  The police advised me to block their number on the phone and NEVER NEVER respond to anything! So far, I have five numbers blocked! Eventually they'll stop!  Once you sound intimidated or alarmed, you're in for daily calls and so is your family!  DO NOT RESPOND at all!

I received a recorded message, said they are looking for a defendant and my name. Recording said to call immediately. I called back and the lady told me I have a debt with Pacific something from 2010 .  She said she is from attorneys office and they are filing criminal charges. She kept asking if I want to settle out of court for some of the money and I would have to pay her 200$ immediately so they dont file the charges..  I told her this is so sudden and what is Pacific.  She said she has my bank records from 2010, read off some numbers and told me they have my IP address that the loan was taken out from.  This reminds me of some numbers that used to call.  It would be a 7 digit number with no area code.  Some People with accents used to threaten me with blocking my social security number.  They are scum and catches people off guard.  She wanted to get my card number but I did not give it.  She said if i don't pay some of it today and make arrangements then a warrant will be issued.  I called her back to ask for the address of this company and License #.  She told me when they issuue the warrant then I will know.  I told her I needed it for the State Attorney's Office..  I hope they get these people.

Please read all the posts.  This is a civil matter NOT a criminal matter.  You CANNOT be arrested for an outstanding debt.  Call your State Attorney General's Office, Consumer Protection Division/Department and file a formal complaint.

Please read each and every post.  Most likely, next they will threaten you with "arrest' if you do not pay them.  If they do threaten you with "arrest", remember, this is a "civil" matter, NOT a "criminal" matter.  Contact your State Attorney General's Office, Consumer Protection Division/Department and file a formal complaint.

I just got a call from this number at my government work phone.  They were looking for a Carlos person and wanted information.  Wow, interesting.  Robo type of call.  This is scary..... after reading through all these posts.  Certainly a new level of using stolen or ID information.

I've been dealing with them for years and they are at it again. I just blocked the newest number they are using to call me (855-775-2417). I never answer unknown or unrecognized callers anymore. I've posted on other threads here in the past for this same issue. Just ignore them, because that's about all you can do, unless you want to waist your time messing with them and filing reports that will go unaddressed by authorities. Reporting to the FTC and your attorney general does nothing to stop them at this point. Just ignore them and block the number. They will not and cannot take you to court. No one will show up to arrest you. They will not mess with your credit. I know this because they've made all of these threats to me in the past and have never followed through on any of them. They will just harass you by phone if you let them. It can by annoying until you learn to ignore them. Now if you do have outstanding debts, check with your lender or credit company. But don't give these people the time of day, and for heaven's sake, do not pay them or give out your information. That's just foolish if you ask me. These scams will continue for as long as people keep talking to them and falling for it.

I owe money, about $750 dollars, to HSBC (Hong Kong & Shanghai Banking Corporation) that I have never been able to pay back.  Kennedy & Cline has been calling me & saying that:
        (1) They are charging me with bank fraud & intention to defraud a banking institution
        (2) That they are starting a criminal case against me & will have me arrested
        (3) That I will need a criminal lawyer to defend myself.
I have connections with several lawyers so this did not frighten me.  In fact, I think that even though HSBC is thought of as a Chinese bank it is actually owned in Britain & that the British outlawed debtors' prisons about two hundred or three hundred years ago.  If this debt collection agency can get people thrown in to jail or prison for owing money in the United States, that would amount to re-establishing debtors' prisons.  As far as I know, debtors' prisons have never existed in the United States.

If you've read all the comments, you'll see that this is a scam outfit - do NOT pay them.  Yes, you may owe a debt to HSBC, however you should NEVER pay money to any caller who refuses to mail a debt validation letter showing that (1) you owe the debt and that (2) they have the legal right to collect said debt.  Per federal law (theFDCPA), refusal to mail this DV letter is a violation of the FDCPA.  You don't have to prove anything to them.  Debt is civil, not criminal, so you're right - no one is going to be arrested.  Failure to pay back a loan  is not "bank fraud" or "intention to defraud a banking institution" - they toss out those terms to scare people into paying a bogus debt, or at least, a debt they don't have the right to collect.

    Be Forwarned
Thank you to all who left comments on this website.  I received a call back from the State Representative's office here in Michigan regarding this Kennedy and Cline company.  The woman who called me back said she had received over 100 CALLS about this company in the last two weeks.  I couldnt believe what I was hearning!  She informed me to screen my calls for at least the next week for calls I do not recognize.  Something happened with my bank merger around August and this is when the weird phone calls from different companies happened and it keeps continuing.  Do not give these scammers a chance to talk; either block the number or let it go to voicemail.  The woman on the phone assured me that I would not be going to jail (she said she has had to assure each caller she received that they cannot go to jail for any debt, regardless of whether or not its real or fake).  This is a scam all the way.

They can not LEGALLY threaten you in anyway or scare you into paying them. My wife is a debt collector in the legal dept for 12 years and all the idiots such as these guys will get in A TON of [***] if they are doing it to you but you HAVE to report it. Her company is monitored by the FDCPA and they are under a microscope but its these little [***] hole places that scare people into paying for stuff that isn't even their debt. Oh and I guess if you say "Do not call this number anymore" Legally they cannot. I hope maybe this helps you relax a bit

This number has just started calling my daughter looking for me as well. I have dealt with companies like this before. It is very upsetting how they can get away with it and the way they talk to you. Many sleepless nights thinking about what they say. I can ignore the calls on my cell but they call my job and leave messages and tell co workers my business. Has anyone been successful in getting an address I am going to contact a lawyer.  Good luck everyone, I know what you are all going through
