- Martin replies to vanessa a| 1 replyI received this phone call today. First I when I challenged them on their policies, the girl then claimed she was new. She stated the investigator on my case was in a meeting, which I asked if that meant her deadbeat boyfriend wasn't back from McDonald's yet. I then advised her to turn the TV in the background down if she wants the scam to at least be somewhat believable. I told her to take down my attorney's phone number and speak with them. She informed me they didn't need to speak with the attorneys as this was between me and the company. I love these types of calls....the amount of anger and frustration I can get out is kind of like therapy :)

It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I nicely told the gentlemen this loan was paid off back in 2011. Of course when I asked what the Account # was he assures me that its not the "same account". I told him I only had 1 account with SP and it was paid and I have all my documents to prove that. He then again tells me if I dont fax the proof over within 24 hrs I will be served legally. I faxed this company over my proof, but I also sent them a Document from my State Attorneys Office (NYS) showing them were its ILLEGAL to try and collect on Payday loans in NYS and they are not enforceable. I have since turned this company and their tactics over to the DFS and my States AG's Office. They are completely violating the FTC laws.

However, it wasn't your job to prove you don't owe, much less scramble to provide anything "within 24 hrs" or any other timetable of false urgency. If they want your money for a real debt, they can send a dunning letter as federal law demands. I will say that sending the state AG notice was a nice dig. I'd imagine they're already aware how NY law feels about them, yet put up the bluff and bluster in hopes that you don't.
The threats, lies, and misrepresentation should make a dandy FDCPA case for you. Consider filing a *real* lawsuit on their tab.

- SH| 3 repliesCalled me at my work today and said he had an officer waiting around the corner to take me in if I didn't pay. He also claimed he was an investigator and this was out of the debt collectors hands and now I am in a criminal case with check fraud. I do have an old payday loan to pay back so this scared the crap out of me. So I was stupid and gave my card number but now I am going to have to cancel the card. He claimed if the payment doesn't go through on Friday then they are coming to "get" me. I really thought they had someone outside to arrest me at my workplace but now I am reading into Fair Debt Collection practices and know this was highly illegal. The investigator's direct line happens to be this debt collector's line. Anybody have any similar experiences and how to deal with this type of harrassment? I have every intention of paying but I do not need these threatening calls at work regarding being arrested. Since I was busy at work he flustered me.

- CWG40 replies to SHTotal scam. Civil debt is civil debt. It is not a criminal matter and you cannot be arrested for ordinary civil debt. Debt collectors have no power of arrest and have absolutely no influence with the police or justice administration. Check fraud is prosecuted by public authorities only. Debt collectors have nothing to do with it. If you had committed check fraud the bank would have notified you. If someone has a valid debt against you then they must send you a debt validation letter and it must be by US mail. E-mail no good. Of course they won't do that. So at that point just tell 'em to go to hell.
Fraudulent or Zombie Debt Collectors—Things to Know
If you have received a call stating:
1. You have defrauded a financial institution
2. You owe an unpaid payday loan
3. You have a warrant due to an unpaid loan
5. You will receive a court summons
6. Authorities are coming to arrest you
7. Anything similar to above,
a. Do not give them any information or verify any information for them
b. Tell them you know they are a scam operating illegally and that you are filing a complaint with the appropriate authorities

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - LBGot call from this phone number today, threatening about pay day loan. I told them I had already taken this matter up with local sheriff, filing police report over a year ago for identity theft. Then later today, got threatening message from Dennis Boyd with call back # 888-293-8346 X 417 or 401that I will be served summons at my residence tomorrow. I looked up both phone numbers, neither were valid.

- SRThey called me twice saying that they had an issue with a bounced check in their off from me. Both times they called the number they called from didn't appear on my phone not evem as restricted but they left the same message both times. In the message it was someone actually talking but when they said my name it sounded recorded. They never say their name or the company

- Mark| 1 replyGot a local call from some woman. She seemed nice but when I asked her where she was calling from, she wanted to verify my identity. When I wouldn't willifully do so, she repeated my phone number, which I accepted as mine. She said I defrauded some bank by writing a check for a loan or something like that. I asked her who the original company was and she said she didn't know, as she was just working with her company and my name popped in the computer. She had my old address on file and I haven't lived there in three years, so I asked her to mail me a certified letter from her company's address listing who the original debtor was with the original debt owed, to which she said she couldn't do that either. I asked for her mailing address so I could even hand write her a formal request for debt verification and she put me on hold "for her supervisor"...the line went dead after ten seconds. I called back and got a voicemail from some non-local, non-Google-searchable company. Bye for all that.
