Some guy named Kevin Fritz calling me saying I owe some $350 for an online loan I got 2 years ago. I didn't get any loan, and am getting the proof from the bank (bank had to mail it.)

His # is 855-834-0185. Kevin Fritz saying he is associated with Nationwide Intermediary Services (http://www.nwintermediaryservices.com/home.html), and he's located at: Nationwide Intermediary Services LLC | Tonawanda, NY 14150 | 1.855.807.8542.

He said that they tried to serve me last week, so I called my local sheriffs office, they have no record of me being served. I then called a private processor, they have no record either.

I then told them I didn't get any hard-proof letter in the mail. Well they said, "Oh you signed up for email notices..." Then proceeded to give me my email (which they had), so I've gotten nothing from the time of date that I supposedly took out this loan. They then sent me a letter with last 4 of my SS, plus my bank account # saying what I owed. [***], it looked half assed. Something from Titan Services. They even knew my last work place!

It seems like a scam, but I want to know what you guys think. I could copy and paste the letter they sent too if you want. Just want to know if you guys know more about this.

    Thanks,
    Jay

This was the "letter" they sent me via email.

    "Dear (my name here),

As per contractual agreement on 07/30/13, the above referenced loan was deposited into your (name of bank) account (banking # here.) This agreement defaulted after an ACH(S) returned NSF. Our serviced were recently retained to facilitate negotiation between yourself and our client. Our client has agreed to extend you the opportunity to remit the amount of $360.95 on 04/17/15 satisfy your account as PAID IN FULL. Adhering to the terms of this offer, with release you of any and all liability regarding the loan, contract and any insufficient funds checks rendered previously. This will pay you in full to a zero dollar balance with the creditor, Titan Service any successors and any and all credit reporting agencies reflecting the derogatory.

If you do not adhere to this offer, the matter can be forwarded to an attorney in your area for legal consideration. If suit is filed and judgement rendered against you, they will collect payment utilizing all methods legally available.

It is appropriate at this time to inform you that lawsuit is a time consuming and expensive proceeding. You may be required to appear in court or have an attorney appear on your behalf. A legal proceeding is a matter of public record. If a lawsuit is filed, a court in your local jurisdiction could enter a judgement against you for the entire balance of your account. In addition, the court could add costs, interest and attorney fees where state law admits such remedy. If a judgement is entered against you, it will appear on your credit report and may affect your ability to obtain future credit.

    Sincerely,

    Mr. Kevin Fritz 855-834-0185"

A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed - US Mail ... not emailed or texted]

    Source:
    https://www.consumer.ftc.gov/articles/0149-debt-collection

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via Green Dot, MoneyGram, Western Union, prepaid gift card or other untraceable means, then the call is definitely not legitimate.

IF you wish to communicate with the supposed collector / creditor, visit  the following page, for example "Action Letters" to snailmail:
    http://www.consumerfinance.gov/blog/debtcollection/

If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:

    Jay -

More information for you, and for anybody else that receives a call from the same number.

    Nationwide Intermediary Services

    A very glitzy website
Internet Domain was created on 1/9/2015  ------ not very long ago
Domain expires on 1/9/2016  ----- they do not expect to remain in business very long

The address shown on their map is the same as that of a closed restaurant:
    http://www.yelp.com/biz/warrens-restaurant-tonawanda
Maybe it is now a UPS store or other mail drop box location, or a "rent a room" for virtual offices.

Nationwide Intermediary Services, LLC is a New York Domestic Limited-Liability Company filed on January 9, 2015, so they are somewhat compliant with NY laws.  If you file a complaint with the NY Attorney General, you may get some action.

I could not find a BBB entry for them.

***A company must be licensed in their state as well as the one they are trying to collect in if two different states are involved.

    Some Tips:
    *Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time, date, who you spoke with and what the conversation detailed.

Wait a minute!  You're saying that these criminals who are trying to steal money from innocent people on the telephone have helped you with a loan?!  Makes folks wonder if you're really that foolish or if, maybe, you just made that up for some reason.

NIS Processing seems to process ... Macadamia nuts (really!)

Are you a Macadamia nut, or are you merely a shell ... err ... shill for some debt collector?

Please give us full info on this "NIS Processing" you mentioned.  Full, legal name; legal address, website, BBB page (if any). Also give us the info on this "mediation company" you mentioned.

On the other hand, if you are referring to Nationwide Intermediary Services, LLC, please re-read my earlier posts, then tell us why you decided to become a Happy Camper in this thread?

So are you trying to say that they waited a year to repo your car?  That seems like a long time for them to wait.  Criminal Title loan companies are not usually that accommodating.  But at any rate, I am sure you would not object to me posting this, now would you?

Also note the infamous Delray Capital was mentioned also.  Since these criminals are all located in Western New York, known haven for criminal debt collector enterprises, it is not too much of a stretch to realize that they are all related.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
