    Caller was computer stating they were serving someone papers that id not live at my residence.  Stated "You've been informed"  When I called the number back to state they had the wrong number, "Samantha" proceeded to threaten me.  When I hung up, she called my number back and proceeded to call me names and continue to threaten me.  I hung up again, the calls proceeded for approximately 45 minutes which I did not answer.

    I received a call from a "private" number. Some RUDE guy trying to sound official stating that papers were going to be served. If I wanted to find out what it was for to call 855-853-6568. Turns out to be BARRON GIBSON &PHILLIPS so-called debt collectors.

    My mother started receiving calls from this number 8558536568 about a week ago. They stated that they would be serving me a summons if I didn't call within 24 hrs. I called them back to see what it was regarding and they stated that I had committed credit fraud that they had been sold a debt recently from a hedge fund company for a payday loan I took out and paid off in 2010. I told them that I don't owe anything and I want documentation sent to me regarding the "outstanding debt" they said that they can't send anything until payment was received and that they would send me a paid in full letter to my email after payment. When I advised that I already paid this debt and that I'm not going to pay them because I don't know who they are and they have no proof of the debt, the man proceeded to yell and threaten me. After said conversation I h/u. he and a female tried calling me 15 times saying I had till 5 PM est to pay the debt because they send the information to Pima County Sheriffs. I contacted both courthouses and neither had any record of any cases against me. I also contacted the original payday loan company that I took the loan out through. They advised me of the company that bought the debt (was not the company that was harassing me). I then called the company that bought my debt who is also the company I paid the loan off with and they advised me that for this type of loan at no time can you be charged, arrested or served court paperwork regarding this debt. She advised that if they call again to tell them "this is your final legal warning to cease and desist. If you do not cease and desist I will contact my attorney general's office" this experience was terrible. I was scared and didn't know what to do. I hope no one ever has to go through this again. This company is saying that they are going to serve me papers. I guess we'll see what happens.

    This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

    The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

    * Debt collectors may NOT
    - repeatedly use the phone to annoy someone.
    - falsely claim that they are attorneys or government representatives
    - falsely claim that you have committed a crime
    - falsely represent that they operate or work for a credit reporting company
    - say you will be arrested if you don’t pay your debt
    - say they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
    - say that legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action
    - use a false company name
    - take or threaten to take your property unless it can be done legally;

    The debt collector may not garnish your wages unless there is a court order to do so.
    Many Federal benefits (including Social Security Benefits) are exempt from garnishment

    You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

    Report any problems you have with a debt collector to your state Attorney General’s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

    TG replies to CREDITFRAUD???
    Unfortunately, I did go thru this and because I was so scared I gave my debit card and they have so far taken $600 until I realized that they were scammers. I am trying to fight this with my bank and so far it is still in investigations. Several other numbers came up and the voice messages were the same. This is no joke. I also filed a dispute with the FTC as well.

    I keep getting the same messages. Threatening messages mind you about how I have 24hrs to respond. I need to know who to contact to file a compliant against theses scammers.

    Caller keeps calling back after I hung up.  They stated I owed a check fraud fee due to giving a company my bank number and not having funds.  It was a check cashing place who I wrote a check to (which they swear I didn't) and it didn't matter that I paid the debts.  They kept interrupting me and refused to give me a name.  When transferred to someone else and questioning who they were they simply said I was wasting their time and hung up.  They told me to have 2 forms of ID and lRge dogs off the premises because they were serving me.

    If someone refuses to name the company that they are collecting debts for it is always a scam. They count on your fear of being arrested to get your money. Make them sent valiadation by usps and if they said they sent it already or claim they want to email you or say they can not do that, then it is a scam.

    Received call on my cell phone.  Message stated that there was fraudulent use of my social security number, and like the others - last thing was that "I was notified".  Husband has also been called stating check fraud.....not calling back.

    Claimimg I recieved $1400 from capital one in 2001 as a payday loan as well saying they were gonna file criminal charges & serve me at my job. Ive never even had anything with capital one. This is so annoying I hang up they call back very rude & out of line so to say & talking about paying them through a debit call...really. Who are these scammers if anybody needs to be locked up its these people how do they even obtain other people information like this it should be against the law for them to harrass people this way

    Extortion Scam Related to Delinquent Payday Loans

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    Total scam.  Only public prosecutors can file criminal charges and that only after a police investigation.  There's no arrest for civil debt.  Don't pay any attention to their stupid threats.

    Tired of Scams
    They called my cell phone and said I was being investigated for check writing fraud.  I don't even write checks anymore so I knew it was bogus.  I am blocking them from my cell phone as I write this.
