    As you say, there is such a thing as "Threatening legal action with no intent or ability to follow through".

    I picked a State at random.  This State lets prosecutors run their own informational web sites.  So I picked a prosecutor's web site at random.

    Let's assume someone buys an item at a store and pays with a check that is NSF.

    The prosecutor said the statute of limitations for a bad check under $500 was 1 year, and for a bad check over $500, the statute was 3 years.

    The CIVIL statute of limitations for intentional fraud, in the random State, seems to be 5 years.  If someone wants to try to prove that the check is a written 'contract', the statute of limitations is 10 years - if the Judge buys that theory - and the Judge may not buy that theory, because a check is actually an "order" to a bank, to disperse funds.

    More likely, if the check is only some of the "evidence" of an agreement to buy something, and if there is no written evidence of the contract, then the statute of limitations on the contract of sale is 5 years.  It's an open question whether a cash register receipt is a written contract to buy, or just evidence of a verbal contract of sale.

    So THIS company is pursuing alleged bad checks, many of which are under $100, and many of which are more than 10 years old.  In the random State, those checks could not be collected civilly, or prosecuted on.  And the evidence that they could not be prosecuted or collected on is on the face of the check - the date of the check.

    This company has to hire people who can read, to do their business.  The employees SHOULD have been provided a list of checks they can't pursue, State by State.  And yet they are pursuing small change, in the form of uncollectible debts.

    (I still haven't been able to understand all the gobbledygook in the last two paragraphs of the CCO's post.  I think at one point, he said that if the person who wrote the bad check was connected with a bad credit rating, he would pursue the check even if there were problems with the age of the check.  I think that would be - what is the word? - dishonest.)

    Just in case someone raises a question as to the validity of comments about a random State, I did some looking.  I wouldn't say it's "legal research".  The information came from the best available sites, but it was bloody hard to find some of the information.

    Here goes, however.  I will give my conclusion at the beginning.  Collecting on bad checks that are 10+ years old is pretty close to impossible in the States where Winn-Dixie stores are located.  According to their web site,

    In Alabama a bad check can have criminal and civil penalties. If you have received a bad check it is important to know the steps to take to recover the check amount. It is your responsibility as the receiving party to make the demand for payment. Generally you have a two (2) year statute of limitations for collecting on a bad check amount.

    Louisiana was the toughest State to research.  Most of the inquiries went to a data base, run by one of the legal service conglomerates.  They would not respond to terms that humans use.

    As to the fog billowing from the rest of your comment, consumer rights do not vanish simply because you've purchased some checks which may have been dishonored. The principle of "Holder in Due Course" is really inapplicable to consumer credit, and it's been that way since mid-May 1976, when FTC Rule 433 became effective.

    I keep  getting  calls on a  check   that is  19  years old.   They even  have a picture of it.  The   check  is 20.00 but they have fees on it that increase the fee  to 198.99  They are also using a number 205-327-1337

    I am a private investigator for a Law firm in Georgia. This company is not out of Georgia or Arizona nor California. I found there business license in the state of Nevada. The owners are Duane christy and billy Kirby there out of a office on 2295 renaissance suit a Las Vegas NV 89120. This company is a scam and fraud I had some of my investigators call them they threaten of arrest as well as taking people to court on 10 to 18 year old checks we also found out that the owner Duane Christy haves another collections agency in Nevada called Aargon agency and there off of 8668 spring mountain rd Las Vegas NV 89117.

    Scammer claimed to be calling from a collection agency, named Check Systems. Claimed I had a bounced check from 1994. No, I do not. My bank would have informed me same day, and there would have been a fee. Neither occurred. I was instructed to call "the attorney handling this case" (no name given) at 866-218-3402. I called. The man who answered identified the company as "Data Check of America". I gave him the "case number" I was given by the man at Check Systems, and was then connected to a woman who identified herself as "Dianna Medick", and claimed to be an attorney with "the fraud department". She claimed my "refusal to pay for a returned check is a crime punishable by fines and imprisonment", and that she was going to file a complaint with the court, same day. I told her "I'll see you in court then", and hung up. Both numbers attempted to call me several times afterward. Last call received at 9:19-p.m. last night. My son showed me how to block numbers on my cell phone, so they are both blocked now.

    I haven't heard that name in a long, long time.  I thought they went out of business.  They would not be able to legally collect on a check from 1994 regardless.

    You will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.

    Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

    You can also file a complaint with the FTC who will then direct you to the CFPB.  Or you can simply go to the the FTC website and file a complaint which will again be redirected to the CFPB.  No matter what you are going to end up reporting the complaint to the CFPB so why not go there first and forget about the FTC?  I mean seriously, you are not actually going to report anything about debt collection directly to the FTC but hey, knock yourself out!  https://reportfraud.ftc.gov/#/assistant
