- Juan| 1 reply866-350-5447 called me, claiming to be Benchmark. She told me I took a loan from check into cash before 2016, that was unpaid. She told me the balance was $2500 but the original loan was $900. She then offered to settle with me for $450. I don't recall taking out this loan and she used jargon as if there would be legal procedures if I didn't take care of the debt(garnishment) I've received no court summons or any proof to support this claim. I believe this is an aggressive collection agency trying to collect on very old debts, using unfair and deceptive practices!

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.
You can also file a complaint with the FTC who will then direct you to the CFPB. Or you can simply go to the the FTC website and file a complaint which will again be redirected to the CFPB. No matter what you are going to end up reporting the complaint to the CFPB so why not go there first and forget about the FTC? I mean seriously, you are not actually going to report anything about debt collection directly to the FTC but hey, knock yourself out! https://reportfraud.ftc.gov/#/assistant

Cash Loan, I told him this is a scam and fraud and he said my name I said it is a scam cuz I never ever used a payday loan or any of the fraud companies he listed like Cash net Usa or Speedy cash etc etc. He got mad when I told him this is a scam he said oh yea I will be sure to tell them you said so LOL. if it was truly a legal matter they would not get mad or yell and then hang up on you! No name just that it was important that I call them back at the 5242 number so I can be connected to a live representative who can assist me. They look forward to hearing from me. He was definitely African American as I am, so I’m 100% sure and he had no type of accent. Why do I need to call a number back to get assistance when I didn’t ask for assistance?

Then he hung up on me.I called him back to ask about what, when, where, how he told me I should know! I reported all of this and made a police report on "Frank Miller" for harassment, identity theft, and SCAMMING!
