- Being RealOne of the better websites I've found to get helpful information about how to deal with debt collection is debtconsolidationcare dot com. They have links you can follow there or you can find other sites that will give you good info. You must have them validate the debt, this must be requested quickly 30 days from when you receive notification from them and you must do it in writing. They must produce the contract with your signiture on it. Without that they have no reason to be trying to collect from you. A lot of things can happen explaining why you would not be aware of a debt. Identity theft for one (even by a family member member of yours)
- They can shove itI was also laid off in January 2009. I am just a middled aged white guy that cannot find a job. B of A jacked my rates, raised my payments and refused to help me with a forbearance. I have this in writing. Now these collection clowns from 'Creditors Exchange' are calling, threatening and relentless. I am fortunate to live in a state where there is nothing they can do to me except flop on the floor and froth at the mouth. I am also recording each and every second of their calls to deliver to an attorney for prosecution.
Their threats have included jail time, wage garnishment (illegal in my state), sell my assetts (illegal in my state), destroy my credit for 10 years (federally illegal in the manner they described). They are calling friends and family (also illegal) but since I have no job they cannot phone my employer.
I demanded proof of debt which they are obligated to provide. They sent me the name and number of Bank Of America to call B of A to validate they are a collections agency. I told them to shove it because the burden of proof is on them, not me.
Fortunately I have a neighbor that works for Citibank and they have told me exactly what they can and cannot do and the tactics they are taught to use. Also fortunate for me I have a brother-in-law that is an attorney that will go after these guys pro bono.- Caller: Creditors Exchange

ATTORNEY GENERAL CUOMO ANNOUNCES REFORM DEAL WITH THREE NY DEBT COLLECTION COMPANIES OVER DECEPTIVE TECHNIQUES
Companies to pay $245,000 to state for violating state and federal debt collection laws, must provide easily accessible consumer complaint forms through company Web sites
Latest action in Cuomo's ongoing probe into unlawful debt collection and settlement practices
ALBANY, N.Y. (June 2, 2009) - Attorney General Andrew M. Cuomo today announced that his office has reached an agreement with three New York debt collection companies that failed to adequately supervise employees who engaged in deceptive and fraudulent methods to collect debts.
The three companies, Creditors Interchange Receivable Management, LLC, Capital Management Services, LP and Tri-Financial, LLC, have agreed to substantially reform their business practices in order to be in full compliance with the Federal Fair Debt Collection Practices Act and New York’s Debt Collection Procedures Act. The companies, which are based in Western New York but do business across the country, are also paying $245,000 to the state in penalties and costs.
“We will continue to investigate the myriad deceptive practices that debt collection companies, debt settlement companies and others employ as a means to exploit consumers who are already down on their luck,” said Attorney General Cuomo. “These three companies have agreed to immediately stop these practices and reform their policies to ensure their collectors comply with both state and federal law. I call on other companies engaged in the business of debt to do the same.”
According to complaints received by the Attorney General’s Office, collectors at the three companies employed fraudulent tactics in an attempt to collect debts, including:
Contacting alleged debtors without a lawful justification for doing so and even after being asked in writing to cease all communication
Contacting consumers at their places of employment even though the collectors were aware that such contact was prohibited by the consumers’ employers
Discussing consumers’ debts with third parties (i.e. employers, neighbors, etc.), and doing so even after the third party told the company to cease such communications
Falsely claiming that the company was acting on behalf of an attorney and that the company or a creditor was about to commence legal action against the consumer
Failing to respond to consumers requests for debt verification
Under separate settlements with Attorney General Cuomo’s Office, the three companies have agreed to enhance their compliance protocols and make it easier for consumers to file complaints against individual collectors. All three companies must create a direct link on their respective Web sites to consumer complaint forms. The companies must also maintain an employee disciplinary history database, as well as a comprehensive database of all complaints made by consumers or third parties who were wrongly contacted by collectors.
For the violations, each company must pay penalties and costs to the state.
Tactics prohibited by both the federal Fair Debt Collection Practices Act, the New York State debt collection and consumer protection laws include: posing as an attorney, threatening lawsuits or other legal action which cannot be taken, saying a consumer committed a crime or will be arrested and talking with third parties except to get location information. The law further requires collection agencies to send a written notice within five days of initial communication with the consumer explaining how he or she can dispute the debt. If properly disputed, the collection agency must stop all collection attempts and send verification.
The settlements announced today are part of a larger investigation by Attorney General Cuomo into unlawful debt collection practices. Last week, Attorney General Cuomo subpoenaed nearly twenty companies and law firms operating as debt collectors throughout the state. His office also shut down two collectors for threatening and intimidating consumers into paying debts that they did not owe. In early May, Attorney General Cuomo announced a lawsuit against two debt settlement companies for fraudulent business practices and false advertising by selling misleading debt settlement plans that very rarely deliver the promised benefits to consumers dealing with debt.
Cuomo also launched a website - www.NYDebtHelp.com - that explains consumer rights, allows victims of debt settlement companies quick access to the Attorney General’s office to file complaints, and outlines the stages of the Attorney General’s investigation. These three cases were handled by Assistant Attorney General Dennis Rosen and Senior Consumer Frauds Representative Karen Davis under the supervision of Deputy Attorney General for Regional Affairs David Sampson and Assistant Attorney General in Charge of the Buffalo Regional Office Russell Ippolito.

Here we go again…another slimy, illegal bottom feeder operation has popped up in Buffalo, NY trying to collect on old, worthless, out of statute debts. Owner Jamie P. Belstadt, a retread of the collection business is trying to collect on debts that are 8+ years old. The documents we saw appear to have been produced by a second grader.
John D. Yim, 36, of North Tonawanda, NY, Vice President of another junk debt buyer called CNE Associates; LLC is churning out the phony documents. Vision Credit Solutions, LLC and CNE Associates, LLC show NOT to have any debt collection license or Surety Bond in any state we checked.
In his phony paperwork, collector Yim refers to the consumer as a ‘defendant’ which appears to violate federal law. His ridiculous form would be better suited as toilet paper than anything worthy of validity. It is pure garbage, nothing he states is true, he makes statements that false, misleading and appear to violate federal law, the Fair Debt Collection Practices Act.
All of these bogus organizations are nothing more than smoke and mirrors to intimidate, harass, lie and mislead consumers into thinking they owe money on worthless accounts. This is typical ‘Buffalo Style’ debt collections that we’ve seen dozens of times.
These organizations are operating illegally, the accounts have no validity, and the statements they make are false, misleading and ripe with lies. John D. Yim has no idea of what he is doing; Vision Credit (started April 2008) and owner Jamie P. Belstadt are as illegal as all the other affiliated organizations collectively known as the Mackinnon group out of Buffalo. See http://www.budhibbs.com/giove
Save your money, these creeps are new players at the old con game; expect the usual threats of pending litigation, posing as lawyers, police and court officials. No one should fall for this scam. If Vision Credit Solutions, CNE Associates or Tri-Financial contacts you, contact us for assistance and referral to a local consumer law professional.
http://www.budhibbs.com/collectorpages/tri_financial.htm - TX-redGot a call for my married son from 866-513-9461; "Miss Atkins" at ext 3908 demanded that my son call her today. Atkins did NOT identify herself as a debt collector in any fashion at all. She didn't even identify her company. She did not follow any of the required procedures for notification. I taped the call.

- AnonymYeah I just got off work and I get a call from CI Inc and a number the one I am reporting with an extension. They are trying hard to get a hold of my parents and are "trying to help them out". I call back, I ask what is this in regards to and since I have nothing to do with this why are you calling me? We cannot answer those questions due to the law is the response I got, I asked them how they have my cell number, they told me that number is tied to their home address along with my oldest sisters and the home number, Neither myself or my oldest sister live with my parents, on top of that I am stationed halfway across the country. Now my cell number is on the same plan as my parents then my response is well why don't you have their numbers, they are not tied to that address, I a calling [***], So I call my dad up give him the number, he calls in. They are saying he owes a lot of money on a mastercard that was closed over 10 years ago, My dad who is currently drunk on vacation said they said they would damage his credit and stuff of that nature. Now I want to call back and ask them if they knew it was illegal for them to call me in the first place. needless to say I will be seeing the Navy Legal about this,

- divorced and unemployedGot a very fast paced call from a man named "Mr Weiss" saying 'my case file # #### #### has been placed on his desk for immediate action. I or my attorney representing me in this case must call him immediately to resolve this file'. Since he gave no pertinent information on what exactly this 'file's, or any details, I am thinking he is just another guy in the call center, trying to harass people who are hurting. Great site, this one! Thanks for posting all this for everyone!

HE IS A BAD MAN and deserves to be treated the way he treats others. His boss "Klein" was no help and while he talked to me, i could hear Kennedy laughing and whistling in the background.

- 86665139461These people must think that the people that they are trying to collect from are awfully stupid. Earlier I received two letters from this firm. These letters were computer-generated. All I will say is that for the accounts in question, I receive collection letters from multiple collection agencies, plus the original creditor. As far as I am concerned, I WAS NEVER NOTIFIED THAT THE ORIGINAL CREDITOR SOLD MY DEBT (if they are not required to notify the debtors of a debt sale, THEY SHOULD BE REQUIRED). I still deal with ORIGINAL CREDITORS ONLY, NO BOGUS AGENCIES.

- 8665139461I was directed to call this number from another number. The person who left a voice mail on my telephone had to repeat the call back number three times (sounded like the person was unsure of exactly what number to leave for me). This number was the third (and last) number announced. Coincidence? You decide. Suspicion(s)? Absolutely
