- Gee Whiz.......| 1 replyI received a message from my boss yesterday that I was going to be served papers if I didn't respond to this phone number of 1-866-676-2139. I got really upset. I called the number and was told that I had an old credit card balance from HSBC in 2006 and was last paid on in 2008 and I was going to be sued civilly for the money. The lady on the phone said that once it went to court and attorney fees, the amount owed was doubled. I spent all evening biting my nails trying to figure out how I was going to be able to pay and keep the case out of court. I was literally ill. And then this morning, a co-worker asked me if I had been served the papers yet in which I have not. I then searched the phone number on yahoo and found this website. I'm not doing ANYTHING. I was also told that the statue of limitations is way up for my state and these people are just trying to get money out of me....Thank you everyone!!

- WhatMy in-laws received a call at their home wanting to know if I would be there to be served. I had actually called the original debtor before and they stated that they have never heard of this company before, I explained the situation and they said this seemed like a scam. They keep telling me I over way over the actual amount, but the original creditor states the account was closed years ago. If this is the case how are there additional charges and fees adding up to $4000 when this card was only a $300 limit. Be aware, any other similar experiences???
- Paul replies to NO SCAM! Beware!don"t pay them anything. All debts over 4 years old are not enforceable for credit cards and other such debts. Only the IRS, state tax boards, student loans, and child support can go after you till settled.
Do not fall for it...
If you do not believe me ask an Attorney. - PaulSomeone giving this number keeps calling my wife when I'm at work. They are following the same tactics that I have read about in other peoples experience. I'm to the point of changing the phone number so that they can't call anymore ( we all know the headaches that causes).
Does anyone have a " Real" address for these people? Or any of their own personal phone numbers so that they can be called and subjected to the same treatment?- Caller: unknown
- ChrisandScottMy husband was called at work today and the owner of his company answered. She was told the same thing that everyone else was told. "Court docket"..."Case Number"..."Summons"..."Call back immediately."
I have NEVER heard of anyone calling to make an appointment with you to have you served. In our state, if you are being served, you MUST have a Sheriff's Deputy serve you and there must be a legal recording of it.
These people have been calling us at different places (our home, cell phones, husband's work, my mother's home, my grandmother's home) for over a year now. It seems to me that if there was a court case, it would have been thrown out.
Also, we do not even own any credit cards at ALL. The last credit card either of us had was in 1990. The only other bill that we are late on is our car payment and I can ASSURE you that we are in constant contact with those people and are making agreed upon payment arrangments as promised to catch up. I have no idea what these people could be suing us for.
According to an attorney, this IS illegal. This attorney also happens to be my sister-in-law. Her husband, a police officer also corroberated the fact that there MUST be a record of the summons in the county for it to be legal. She sent me the following:
What types of debt collection practices are prohibited?
Prohibited behaviors include harassment, false statements, and other unfair practices.
Harassment
Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, debt collectors may not:
• use threats of violence or harm
• publish a list of consumers who refuse to pay their debts (except to a credit bureau)
• use obscene or profane language
• repeatedly use the telephone to annoy someone
False statements
Debt collectors may not use any false or misleading statements when collecting a debt. For example, debt collectors may not:
• falsely imply that they are attorneys or government representatives
• falsely imply that you have committed a crime
• falsely represent that they operate or work for a credit bureau
• misrepresent the amount of your debt
• indicate that papers being sent to you are legal forms when they are not
• indicate that papers being sent to you are not legal forms when they are
Debt collectors also may not state that:
• you will be arrested if you do not pay your debt
• they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so
• actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action
Further, debt collectors may not:
• give false credit information about you to anyone, including a credit bureau
• send you anything that looks like an official document from a court or government agency when it is not
• use a false name
Unfair practices
Debt collectors may not engage in unfair practices when they try to collect a debt. For example, collectors may not:
• collect any amount greater than your debt, unless your state law permits such a charge
• deposit a post-dated check prematurely
• use deception to make you accept collect calls or pay for telegrams
• take or threaten to take your property unless this can be done legally
• contact you by postcard- Caller: Unknown - they wouldn't say
- MP Mom| 1 replyI just recieved a call that matches exactly what others have posted: A man with a stern voice gives the impression that an attempt to serve a summons was made, and states I need to call 866-676-2139 IMMEDIATELY to arrange another time to be served b/c they closed at 7p. I call, spoke with Vickie at Maple Filing Services, and although the debt is supposedly at $1958, the original creditor (HSBC) may be willing to accept the original unpaid debt: $567. When I tell her I can't afford to pay the current amount, she puts me on hold to speak with HSBC. Vickie gets back on the phone and says they will accept $567 PLUS $250 to cover filing fees already paid. She went from saying it must be paid within 30 days to "Oh, I'm sure it will be okay as long as you make the last payment as close to the deadline date as possible." She would not give a specific address, just "Riverside County, CA". When pressed she said they had several addresses for different departments. I asked for the name of the HSBC rep she contacted for approval, and she refused, saying "it doesn't make any difference because you're dealing with us." I asked her how could her agency make payment arrangements when she stressed they aren't a "collection agency", just an agency hired to handle filing summons. Answer: They just gather the information and relay it to "PMR" (another CA location) for processing payments. Finally, she started bullying, saying she doesn't need to waste her time or mine, so either I'll agree to payments or take my chances in court. Although she had my address, the county was five states away. I kept asking for specifics: HSBC contact's name, HSBC contact phone number (she said she didn't have an 800#, so I told her that's cool b/c I have unlimited nationwide), or which court the proceedings will be held in. I was obviously plucking her nerves. I could hear men's voices in the background, similar to a call center.
Here's Statue of Limitations (SOL) information for North Carolina. I found it on http://www.fair-debt-collection.com/SOL-by-State.html#34.
North Carolina Statute of Limitation
Express or implied contract, not under seal: 3 years.
Contract and sale of personal property under seal: 10 years.
Open account: 3 years, NOTE: Each payment renews the SoL on all items purchased within the 3 years prior that payment. If no payment is made, the SoL runs from date of each individual charge. Contracts: From date of breach or default, unless waived or performance under the contract is continued.
Judgments: 10 years
Partial payment BEFORE the SoL expires renews the SoL from date of payment.
Payment AFTER SoL expires renews SoL ONLY if, at time of payment, circumstances infer the debtor recognized obligation to pay. Partial payment on open account restarts SoL on purchases made within 3 years of payment date, if acknowledgment can be inferred, starts the statute anew as to the full obligation acknowledged, even if all of the charges were not made within the last three years.NC Continued...
Partial payment by one debtor does not renew the statute of limitations as against any a co-debtor unless that co-debtor agreed to, authorized or ratified the partial payment.
Partial payments DO NOT affect the ten-year limitation on enforcing or renewing judgments.
Bankruptcy, Death or Disability: Filing of a bankruptcy tolls the statute of limitations for the enforcement of contracts and judgments.
The death, minority, disability or incompetence of a debtor also tolls the limitation period until such time as a personal representative of the estate or a guardian of the incompetent or minor is appointed.- Caller: Maple Filing Svcs

- . replies to NO SCAM! Beware! This is another head of the Corona Scam hydra.
Usual MO: Fake "process server" calls to relatives, threatening to "send the police", or "have you arrested" if you don't call back, threats of a "lawsuit" that was never filed, never any proof, and shill posts on any complaint forums to try to counter all the consumer complaints.
Check your credit reports, and you will probably find they recently got your credit file, giving them the information to guess what your are good for, along with the names of your creditors from old accounts.

- GloMy sister-in-law (lives about 100 miles from me) got a call looking for me & my husband. The caller said they needed one of us to sign documents and wanted information on us. She did not give them any info, just said she would relay the message. We have no idea what it is about because we have not received any phone calls at home or had any letters from Maple Filing Services & we have lived at the same place with the same number for 30 years. You would think they would try to speak with us instead of hunting down family members that know nothing about our personal affairs. When they send us some type of specific information of who or what they are wanting, I'll take the threats more seriously.
