    I have received calls for four weeks from 866-834-2446. I do not have a Capital One card. I will NEVER have a Capital One card. Today, while I was out, they called 10 TIMES and did not leave one message. I called the number on my caller ID - it was Capital One. I told them if they EVER CALL me again I will sued them for harrassment -- and I don't even have one of their stupid cards!!!

    Don't kow what Capial One does to their poor card holders - assassinate them???

    They use the same number to call me at least 20 times per day.  My husband finally answered and asked who they work for and they said they are Alliance Capitol One.  He yelled and threatened, yet 30 minutes later they called again.  How do we stop these people?  I pay Capitol One every month, always a few days late because of the timing of my SS, but they do get paid every month.

    Phone # on Do Not Call list, anonymous call block on and have blocked #'s as carrier instructed.  This is ludicrous, never anyone there when pick up and when let go to voicemail NO message.  All is documented someone's head will roll.
    Never been A Capitol One, Alliance Finance or any other financial institution customer mentioned in this message thread.  Have made up my mind to phone local law enforcement and press harassing phone charges against whoever these people are.

    Between this # and 866-811-5308, we are being called and average of twice an hour from 8am to 10 pm.      There is no one on the phone.     It appears to be some kind of automated dialing system.
    I've talked to two people in the last two months trying to collect overdue credit card balances and have told them they are after another person w/ my name.  I gave them my birth date and they seemed satisfied but the calls never lessened.     We let the answering machine pick up the calls.  There is never a sound.....

    This telephone number has called my cell phone numerous time during the day. I did advise them that it was the incorrect telephone number for who they were looking for. Even with me telling them it was the wrong number they still kept on calling. I finally called them and told them they were being recorded, asked for the reps name and told them they have the wrong number. The rep said they will take my number off of their list but it would take 1-3 business days. If I continue to receive calls I will definitely file a proper complaint.

    Received 25+ calls from 866-834-2446 in the last few weeks. Calls were made at all hours of the day. At times in the mornings, other days in the evening. I don't answer these calls and whoever is calling, may it be Capital One (which I don't have), a Telemarketer, etc., they never leave a message. Very annoying indeed.
    Since all my phone numbers are registered with the "Do Not Call List", it is my intend to report the number/the caller for harrassment.

    If they don't respect your request to stop calling over the phone, this is the only thing you can do--and I know this from the hell of trying to get 20 Collection Agencies off my back even though I don't owe a thing (but do have a listed number and common surname). Do get your credit report to make sure you don't have negative accounts reported you don't know about. (The NYC Dept of Consumer Affairs recommends https://www.annualcreditreport.com/ They're free)

    You send them a debt validation and limit communication letter by mail--certified mail, return receipt requested. You make sure you make a copy of the letter, and of the envelope with the certified mail sticker attached and of the return receipt and that you put the certified mail number on the letter itself. I find that takes care of three-quarters of CAs--that they'll stop once they receive that letter or soon after. Some won't though (including Alliance One it seems who got my letter the 20th but are still calling). I give them some time, about a week to see if it gets through their bureaucratic skull.

    And then? Report them. It's more powerful to do so if you have the documentation you asked them to stop. Report them to the Federal Trade Commission online, report them to your State Attorney General--and see if there's a local agency as well. The FTC and the NY State Atty General did nothing on my behalf--but the NYC Dept of Consumer Affairs called and wrote Global Credit and NCO Financial on my behalf and stopped their calls when I couldn't.

    Here is the letter I sent to Allied One with the personal info removed (you may want to look up the laws in your state, locality and on the FTC website and tailor your letter accordingly. New York City law, for instance, has protections not available in other parts of the country, but the federal Fair Debt Collection Practices Act is still pretty powerful in its protections):

    I added the line about them not getting more personal info and that I don't credit they can't find my account when two Collection Agencies wrote back claiming they couldn't find it--and NCO Financial then asked for my Social Security Number--which you should never, ever, ever give them)

    Re: Your Calls to 212-XXX-XXXX

    To Whom It May Concern:

    This letter is being sent to you in response to numerous calls made since September 10, 2010 to 212-XXX-XXXX from 866-615-0531 and 866-811-5719, both source numbers associated with your company. Your representatives have never stated whom you wish to reach--or indeed, even left messages. Which in and of itself is a violation of the law. Collection agencies in my state are required under law to state whom they are trying to reach and the amount and nature of the debt each and every time they make contact. In addition, a collection agency may attempt contact only twice a week under New York City law. Yet your representatives have called my number 12 times in under a week and four times on the 15th of August. This is unacceptable.

    Given you are a collection agency, I am sending you this notice pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that any claim is disputed and validation is required in an attempt to force you to correct your records and cease your calls. You will not receive any further personal information from me, and I do not accept in a computer age that you cannot find the entry associated with my phone number.

    This is not a request for “verification” or proof of my mailing address, but a demand for VALIDATION made pursuant to the above named Title and Section. I demand that your offices provide me with competent evidence that anyone at 212-XXX-XXXX has any legal obligation to pay you anything, giving you any pretext to make contact.

    Please provide the following:
    ·  What the money you claim is owed is for;
    ·  Explain and show how you calculated what you claim is owed;
    ·  Copies of any papers proving I agreed to pay what you claim;
    ·  Provide a verification or copy of any judgment if applicable;
    ·  Identify the original creditor;
    ·  Prove the Statute of Limitations has not expired on this account (6 years in New York)
    ·  Show me that you are licensed to collect in my state - New York
    ·  Provide me with your license numbers and Registered Agent
    ·  Proof that you own the debt/or have been assigned the debt.
    ·  Complete payment history, starting with the original creditor.
    ·  Copy of the original signed loan agreement or credit card application.

    At this time I will also inform you that if your offices have reported invalidated information concerning anyone residing at this number to any of the 3 major Credit Bureaus (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following: Violation of the Fair Credit Reporting Act; Violation of the Fair Debt Collection Practices Act; Defamation of Character.

    If your offices are able to provide the proper documentation as requested in the following Declaration, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist.

    Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with legal counsel for suit. This includes any listing of any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

    If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to any account associated with 212-XXX-XXXX must be deleted and completely removed from the credit files and a copy of such deletion request shall be sent to me immediately.

    I also demand, in writing, that no telephone contact be made by your offices to 212-XXX-XXXX. If your offices attempt telephone communication with me, including but not limited to computer generated calls (including hang-ups) and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to take legal action. All future communications with me must be done in writing and sent to the address noted in this letter by USPS. If you are still calling me after receipt of this letter as verified by USPS, I will file complaints with the Federal Trade Commission, the New York Attorney General's Office, the Pennsylvania Attorney General's Office and the New York City Department of Consumer Affairs. To call me after receipt of this letter is a violation of the Fair Debt Collection Practices Act, and you can be fined for each violation. I have Caller ID and am keeping a detailed phone log.

    This is an attempt to correct your records and stop your harassing phone calls; any information obtained shall be used solely for that purpose.
