- SmittyI received a call from 866-896-7987 which was a prerecorded message, prompting me to press any button to be connected to an agent. I was connected to a female agent who quickly (too quickly) identified herself and the company she represents. I asked her to repeat what she said as I didn't understand her. She said it slowly, and stated she was calling to speak with Smitty (me). I told he I was Smitty, and asked her what this call was about. She insisted that I verify some information about myself before she would tell me what the call was regarding. I explained to her that she called me, and I told her that I was the person she was looking for, and as such, it was she who needed to explain to me the purpose of her call. This went back and forth until she threatened to hang up. I hung up first.
My husband and I had filed chapter 7 bankruptcy almost one year ago. A payday loan that I had defaulted on was included in our list of creditors, and the payday loan company was notified of the "stay" imposed upon them by way of our bankruptcy filing. I do not get calls from the original payday loan company, or they would be in violation of the automatic stay order. Instead, the payday loan company provides my information to third party collection companies who will be given a percentage of the money they are able to collect from me. Our bankruptcy has been discharged, and my payday loan is no longer a valid debt, yet these collection people will stop at nothing to intimidate me in to submitting to their demand for a payment I am under no obligation to pay.
When you file bankruptcy, it is public record. A complete list of your creditors, their addresses, and amounts owed are available for the public to view (pacer.gov), and anyone can access your bankruptcy documents, and act as a free agent to collect on a debt under the pretense that they are an authorized collection agent. Your name, address, phone number, and tons of personal information is available for these vultures to use in an attempt to scam you into paying them for a debt you no longer owe, and one in which they are not authorized to collect on.
If you're getting calls from this number, it is a last ditch attempt to collect on a dead debt, and they know it, they just hope that you're stupid enough not to.- Call type: Debt collector

If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them.

Ignore and block these calls. If you were the subject of a pending civil lawsuit, you'd have received a letter from the attorney for the other party. You'd have a paper trail.
Then, if a case was filed, you'd have received a summons delivered to you by someone licensed to serve process in your locality. You would NOT have first heard about any civil law case from some scammery-scummery debt collector who cold calls you and starts demanding money.
You can check this out yourself by simply going down to the local main civil court and checking the defendants civil list. saying that I am going to be prosecuted for a mysterious complaint that is being filed against me. They have called my wife's autistic brother on his phone screaming at him and scaring him to death, if he doesn't tell them where I am! They also started calling my mother in law and my father in law, leaving threatening messages at their homes! My wife and I don't owe anyone... and this is becoming emotional abuse at this point!! - CWG40 replies to ChrisFor the time being you'll have to rely on call blocker. Simply ignore and block the calls. Don't let them bother you. This is a debt collection scam and all they do is make threats.
Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.
