- bnb1031This company is ruthless! I applied for a car loan 3 months ago & they have not stop calling several times a day since. Obviously they are monitoring our credit reports since you have to fill out addresses, previous addresses, employers & former employers and list references. It opens the door for them to obtain all of our current information. The debt they are calling on is more than 9 years old and was acquired in a previous marriage. The debt was charged off by the original creditor & is no longer in my credit report so I don't see how it is legal OR ethical but apparently they "purchase" bad debts for pennies on the dollar & try to intimdate people into paying them.

BaroneBeen Receiving this call from this number 856-668-4528 or 856-668-4520 for about 3 months now it's a recording asking for a japanese name from a collection agency and if I stay on I admit to being this person. I called my phone company to block the call but it came right back through and now a new number it's 866 932-6805. They call all times of the day a random I have to keep my phone on vibrate because they will wake you up any day except on the weekend i don't receive a call on the weekend.
I'm not sure what this is about I don't answer my phone an more it it's important I figure they will leave a message or a I will recognize the number or area code. only a handful of people have my number so I do hope this problem is remedies very soon.- Call type: Debt collector
- Suing Telemarketers - Simple and CheapYOU CAN SUE THEM WHERE YOU RECEIVED THE CALL BECAUSE THEY ARE DOING BUSINESS IN YOUR AREA!
When most people think about the process of suing a business entity, they naturally consider it a complicated and expensive process. They consider having to find an attorney who specializes in the particular area of law, the costs for such and weigh it against the potential gain. Forget all that when it comes to suing telemarketers!
For those individuals like me who have successfully prosecuted cases against telemarketing firms, there is little need for an attorney. (A cover-my-posterior caveat: I am not an attorney, so I cannot legally advise you. Whenever you are considering legal action, it is always advisable that you consult an attorney. Personally, I have never needed one when filing claims against telemarketers, but you may wish to consider doing so.) The key is that the best venue for filing suit against a telemarketer is in your local Small Claims Court. The only fees you must pay are the filing fees (varies upon venue and amount, but generally is somewhere around $50) and the fee to perform service of process (anywhere from $10 to $100 depending upon whether or not you have the court serve the telemarketer via certified mail or you have a law enforcement officer or other process server handle such). When the potential gain is thousands of dollars, what is a hundred bucks?
I have personally filed four claims in Small Claims Court against telemarketers. I have been paid on three of them (the fourth was against SBC and they gave me such a runaround on the process serving - BUT they stopped calling) that I let that one slide. Of the three cases where I was paid, the following were the results:
1. Filed a claim against a telemarketing firm based in Florida (Health Benefits Direct) for $1500. This amount was based upon two calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy. I settled out of court for $600.00 prior to the trial date.(Initial Cost to me: $55)
2. Filed a claim against a mortgage brokerage firm in southern California (due to settlement agreement, I cannot reveal their name) for $4500. This amount was based upon seven calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy and their failure to maintain a Do Not Call List. I settled out of court for $2000.00 prior to the trial date. (Initial Cost to me: $80)
3. Filed a claim against a mortgage brokerage firm in southern California (Country Club Mortgage) for $3500. This amount was based upon five calls made after I told them to stop calling and their failure to provide me with a copy of their Do Not Call Policy and their failure to maintain a Do Not Call List. I received a judgment for the the full amount of $3500, plus $60 in court costs. (Initial Cost to me: $60)
Adding up the above numbers, you can see that I invested $195 (or $250, if you consider the SBC claim that I let go) and received a total of $6160.00. Such is obviously a pretty good return on my investment and I doubt I spent more than three hours total on everything (five hours if you factor in the time I had to waste sitting in the court on the last action). Please also note that my local Small Claims Court allowed me to file everything through an online form. I didn't even have to go to the bloody court house, except in the one case where the telemarketer didn't bother to settle. So what do I do with the money? Well, I have been torn. On one hand, it seems a pretty smarmy way to make some money. On the other hand, these jerks are violating the law. I came to a compromise. Some goes to my child's future education; some goes to buy supplies for our troops stationed in Iraq, Afghanistan and Djibouti; some goes to basic household things. (And of course some goes to Uncle Sam as it is taxable income!). (UPDATE: I have been informed that this is not necessarily considered taxable income, but I prefer to be safe and treat it as such. Feel free to consult a CPA.)
Suing Telemarketers - So How Can You Do It?!
Remember, I am not an attorney. I discovered this information on the internet and learned through trial and error how to go about the process. Just like you, I become incensed when I get those calls and they will not stop. I decided that the only way that these firms (especially the mortgage firms) will stop their behavior is if more and more people avail themselves of their right to private action. - Another PersonRecieved this call today. "If you are not _____ then hang up. Please refer to number ______ when you call back" or something to this extent. We're in the process of refinancing our house and a number of credit agencies were contacted by our mortgage co, so this may be where they get info. We do not have any debts so if they need us they'll have to write a letter. I blocked the caller on my phone so hopefully we won't hear from them again.

- WillisI received repeated calls from 866 932-6805 over several weeks, but never a message. I finally got a person to come on line by answering and then pressing the # key a dozen times. The near-illiterate clerk then asked for "Reginald Hunt" -- an unknown person that has never lived here (and I have used my phone number here in Florida since 1959).
He was resistant to my demands to know his firm's name, saying it was a legal matter that he could not disclose (!). I promised to report him to the FCC, which I have done.

- mr manI got this call first time today, 8:18 am, when I get a call at 8 in the AM, I am pretty sure it's someone I don't know and I don't want to talk to. I just included their number in my contact list and set ringtone as no ringtone. someone said they would have to change their cell phone number, why? the beauty of cell phones is you can block any number. I always give my cell phone number first now, just in case someone decides they want to call me, I can screen them out.

- AnonymHave been receiving automated phone calls from this number for the last three months looking someone named Troy -- Darned if I can understand what the automated voice is telling me. They all got to the answering machine, where the message does not leave a number to call back on, but indicates that by not responding (gee, how does an answering machine RESPOND I'd like to know) that I'm acknowledging that I'm this Troy person and that it's urgent we contact them ASAP. But again, they leave no number. I've had my home phone number for close to 30 years and there's no one named Troy living in our home nor has there ever been. Since these idiots and their automated machine aren't smart enough to leave a number to call back on for me to tell them that they have the wrong phone number/wrong person, I'm at a loss as to what to do.

This is a scam and denoted for your records this contact number can be properly investigated. If they have no jurisdiction of collecting any monies from the current state your in they can and will be sued. Case closed.
