- WILL| 1 replyPrivate debt finder. Woman said she was going to have to come out and serve me with legal papers. She's just gonna have to come. Not even sure what this is for. I have many debts. Wont stress it they can't get what I don't have. If I hit the lottery, I'll pay or maybe if america pays me my reparation I can hook them up.
- AnnaNot sure who this company is but the caller said he was a private locator named Kevin Phillips in my area (Houston), who was hired to serve me papers regarding to "financial charges" being filed against me. If he was any good at his job he would know that I don't work. He doesn't identify the company who hired him but gave me the 866 number to call with a claim number. If there are 2 then there should be 2 claim numbers. Don't fall for it, if you owe someone they will contact you directly or just wait for the "legal" paperwork to be served to you.

- Connie| 1 replyThis number called my cell and also my dads house saying I had bad checks and I was going to be arrested. I don't write check. When my husband called number was disconnected when I called got a recording saying capital loss management. When the man named Michael Williams left a message it said god luck and he hopes he don't have to come to my place of work and residence. I received calls such as this before being a scam. These people are trying to scare people and they scared a friend of mine into giving her acct info and paying them money. This is horrible and I am not falling for it. ANYONE HAVE INFO ON THIS NUMBER OR PERSONS NAME OR A SIMILAR CALL?
Thanks
Connie- Caller: Capital Loss Managment
- Melissa replies to ConnieI just got a call with a similar message. I don't write checks, so I'm not exactly sure what the person was talking about. I'm guessing it's a scam?

- Charlotte| 1 replyMy roommate got a phone call from a guy named Michael Williams saying she needed to pay a certain amount of money or she would be served. My roommate was at work when she got this phone call. Later she told me when she came home what happened so I did research and found that it was a scam. Well my roommate paid the amount of money she was told over the phone when she took the phone call. Does anyone what she can do now to get the money back? Could anyone give me any advice?
- Sharla replies to CharlotteJust tell your friend to call them and ask for a receipt. I doubt she would pay something if she didnt owe it? If she paid the debt they have to issue a receipt within 45 days. I dont know how it works for a partial payment. PEOPLE-- IF YOU ARE UNSURE OF WHO YOU ARE PAYING, THEN JUST ASK HOW THEY CAN VERIFY THE DEBT. Legally you CAN be sued for these stupid pay day loans. Will they go through with it? I guess it depends. If you dont pay it, it MAY end up being a judgement against you IF they decide to pursue it. Every situation is different.
- cedrickthey got me. i needed money blahblah. i called there office but i was already in trouble for using false info so i dont know why they were even bothering me at this point. I dont know about getting a supena for the det but i did get in trouble for using false info on loan app. its that contract that they got me with i guess its worth a lot more than a promise to pay it back
- Laura BrownLeft me message saying it's a fraud case.

- Alfalfa replies to unknowThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors - LG| 1 replyThese people called my fiance's father demanding that my fiance get in touch with them, or they would have the county sheriff come to his place of employment, and arrest him. My fiance got a hold of them, and they pretty much bullied him into giving out his bank account info. So now for the next 3 months, they will be taking out $300... He did this before I could call them myself, and when I did.. OH BOY! Spoke to 2 rude men who tried to bully me, but I have dealt with [***] like this before! One guy's name was Walter, and the other was [***]! People, BE VERY CAREFUL with this company. They try to bully their way into getting you to pay for debts they can't even prove are real. The # is 866-967-5818
- Caller: not sure
- Call type: Debt collector
- Tamianth replies to LGHe needs to contact his bank then and file fraud and stop the payments! If he needs to, open a new account! The FDCPA laws are explicit and there are a lot of extortion scams going on right now.. see Alfalfa's post above for more info! Also file reports appropriately! If they are legit, they have to send you the info in writing, not phone, not email, not fax, but in writing!
You cannot be arrested for owing money! Its a extortion tactic.
Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."
