    According to their website at http://www.assetcollect.com/arg-index.php, they contract with a law firm to go after debtors whom they deem financially able to pay the debt. They are careful enough to only "imply" that they are a law firm by stating on their seldom left voice mail that they are calling from "ARG's Legal Department" which technically violates the Fair Debt Collections Practices Act of 1978, which says that Debt Collectors "may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt, including the false representation or implication that any individual is an attorney or that any communication is from an attorney."

    "When it is determined voluntary payment cannot be achieved and sufficient assets are located, legal action can be taken. All collection personnel are trained to review the responsible parties' financial situations. Consideration is given to family size, recent hardship, and income position. Litigation is considered only in cases of those who truly have the ability to pay, but refuse to do so.

    Accounts that qualify for litigation are assigned to our legal department. Upon management approval, the account is prepared for suit by obtaining authorization and acquiring sufficient documents to support the debt. Collection is then pursued through post-judgement executions, such as wage garnishment, until satisfaction of the debt is achieved."

    I'd like to know what information they have access to that tells them a person's income, expenses, hardships, etc. I'd also love to know how they get around the statute of limitations on these ancient debts.

    They said they are ARG Legal.  Also called themselves AR Group.  They said they wanted a deposition. When I told them I had proof that I paid back the debt from a Vandelier, they asked me to email over the proof. I tried the address he gave me and it came back saying the address didn't exsist. My advice is get a call recorder and record the call. Know the FDCPA and document everything. They said they would email me validation of debt as well as mail it to me.  The call was recorded, so if they try and do something I will slap them with a law suit. There are many attorneys online who will represent you free of charge and take a large chunk of the settlement. I usually get $500 back instead of $1000.  There are some shady collection companies out there, so record every conversation.

    Today a different man, calling himself Mr. McNeil, called and left a voicemail stating that he was calling on behalf of ARG Investigations, and that was calling in reference to some "pending charges that are being filed against you in [inaudible] county." He asked me to call him back at 866-967-5820. I have told this agency [read: goon squad] not to call me at my place of employment. Apparently they think that changing the name of the company from ARG to ARG Legal to ARG Investigations is enough to get around that request. But the way I see it, it's just another violation of the Fair Debt Collections Practices Act, and as such has been downloaded, saved and backed up with a growing heap of other such violations perpetrated by ARG.

    Also, wouldn't it make more sense for a debt to process through an agency's "Investigation" department waaaaaay before it ever ends up in the agency's "Legal" department? Ass-backward [***].

    FYI: I get the feeling Mr. McNeil and his fellow ARG Collectors use this site and the comments from those of us they try to call as part of their collections research. 5 missed calls from them since posting the update yesterday.

    They use the term "charges" to make you think there are actually criminal charges pending against you.  Which is total nonsense.   If there were, you'd know about it because you'd have been interviewed by members of law enforcement.

    These guys are doing what they do; which is trying to scare you into paying something.  Total scam.

    I thought these postings was in fun and games until I looked at my check stub yesterday and found out my check was being garnished for 125.00 by ARG, NOT LAUGHING NOW!!!!!!!!!!!

    Perhaps because certain garnishments are not legal?
    Maybe because you "forgot" to tell us there was a court order?

    This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

    The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

    * Debt collectors may NOT
    - repeatedly use the phone to annoy someone.
    - falsely claim that they are attorneys or government representatives
    - falsely claim that you have committed a crime
    - falsely represent that they operate or work for a credit reporting company
    - say you will be arrested if you don’t pay your debt
    - say they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
    - communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
    - say that legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action
    - use a false company name
    - take or threaten to take your property unless it can be done legally;

    The debt collector may not garnish your wages unless there is a court order to do so.
    + Many Federal benefits (including Social Security Benefits) are exempt from garnishment

    You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

    Report any problems you have with a debt collector to your state Attorney General’s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

    You're not laughing? WE ARE! You bottom-feeders try this BS all the time. You sit there & think that only your targets are going to see this. You're idiots!
    Only by court order can there be a garnishment. Meaning that a summons will be issued, signed by a judge. You will be served a summons by a process server or deputy. A hearing will be held and if a judgment is awarded to the plaintiff, wage garnishment may ensue. A debt collector can NOT garnish a pay-check!  EVER!
    Now I'm sure you'd like to come back here and argue this issue with me. By all means, do so! When you return be sure to have your outfits full name & valid physical address! You've "been garnished" so you have all of that information. And don't think you can get away with posting some "suite" number at a mail drop or a P.O. box number. We will take you apart.
    The low-life, minimum-wage fraudsters that have lowered themselves to the point of having to scam for budget JDBs make us nauseous here.
