This company has threatened me with federal marshalls and everything else.  They keep calling my cell phone and have called my employer several times.  It's so embarrassing, but yet it makes me so mad that these people can continue to do this.  I've went as far as contacting my local law enforcement and the Ohio Attorney General's office only to be told, "it's so hard for us to try and do anything because these people move around so much or they give a number that when you call it back it says it's not a working number."  How discouraging is this?

I have been dealing with these people for years. They claim its a unpaid payday loan. They have threatened to serve me with court papers, to have my license suspended, to arrest me and even went as far as calling acting like a sheriff (from a county I havent lived in for over 6 years) that was trying to serve papers and needed my address. I have never recieved any information in the mail regarding this debt and no one has ever shown up to my home. They wont work up any kind of payback, they want all or nothing. They have even gone as far as calling my family members and asking them to pay the debt for me so I don't go to jail. Its an obveouse scam and the more you answer the more they will harass you.  Don't give them a dime and keep blocking their numbers (they will have several they will call from)

Why haven't you done something to stop them?  Why would you put up with them calling you for years?  Here is what you need to know and to do, so you can take this advice, or put up with the harassment.  Your choice.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Threatening you and pretending to be a Sheriff are against all State and Federal collections laws, as well as the law against pretending to be a law enforcement officer.

You need to send them a certified, return receipt debt validation or cease and desist calling letter (think of it as the best $6.47 you ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/

Everything else you need to know follows including at least two agencies where you should report their criminal activities.
