Answer the phone and set up another time to discuss payment. It doesn't stop the calls but you are more in control of them and its kind of a good faith offering in their eyes.

Just got a call from this company looking for my mother and they had the completely wrong name, but it was close.  Requesting her contact number which I refused to give out.  I called them back and spoke to Juanita Mitchell and informed her that I looked them up on the BBB and not to call again also she would not tell me how she got my number that happens to be in my mother's name. Beware people!

Called the Ohio Department of Education about my student loans and they verified that my loan had been sent to a collection agency GC Financial to be exact and that they can assist me with doing rehabilitation on my loan.  She stated that is what happens when we default on payments.  I told her about my conversation with GC Financial and how the gentleman Marvin got testy when I told him I needed to call the ODE regarding this just for my own understanding and protection.  The above link is to use to file complaint with the ODE regarding any problems you have with a debt collector.  I am going to download and use the form to file a complaint with them on this company because we do have our rights to protect ourselves against con artists.

Got a call today from 215.478.6040 telling me to call THIS number, 877.244.7901. When calling 215.478.6040 back, I get a message that the number isn't in service.

The name of the company that uses the 877.244.7901 number is GC Services, a student loan collection center. The fact that they're using a spoofed number should tell you something about the company. I have proof that they called me from a spoofed number, because the gentleman who called *left me a message telling me to call this '7901' number.* Tread carefully!

Same happened to me as above, I got a call from: 8162721173 from "Kristen Cowen" (sp?) saying to call: 877.244.7901

Looking up that number took me here.  It is illegal for them not to identify themselves as a debt collector, how can we start a class action against these scumbags?   I bet they log if your number calls back or not.  Trying to have a normal life without wastes of skin like these harassing you is getting difficult in the USA.

If you are debt collector, take a step up in life and kill yourself or become a crackhead, do us all a favor.

} It is illegal for them not to identify themselves as a debt collector

Depends. Are you the alleged consumer debtor or the ACD's spouse, attorney, or guardian? If yes, you get to hear the "mini Miranda". If you're none of those people, you can be told almost nothing, including the call purpose. Agencies leaving messages have the awkward issue of possibly violating one rule to satisfy the other. The famous case of Paul Foti vs. NCO rewrote the manual for debt collectors everywhere, prodding many to treat phone messages like skip traces and reveal nothing which might trigger a privacy complaint.

} how can we start a class action

Why do you want one? Are you certain that thousands of other people share precisely your same complaint? Is it a complaint for which you are entitled to relief? In other words, was the same law broken repeatedly? Then, do you want to spend a year trying to certify the class (which often fails), another few years deflecting dismissal motions and haggling details with defense attorneys who are locked in denial, and then a half year after the fairness hearing watch the attorneys collect eight figures while the class members are each mailed two dollars and a Dairy Queen coupon? Because that's more or less the life cycle of class litigation, during which time GC will never stop its lawbreaking business model. Meantime, individual plaintiffs have come and gone and scored a few grand apiece on real claims in less than a year. Choose your battles and your arenas wisely.
