Left a message and “case” number and that are going file civil complaint to my city. Also stated that I refused to answer papers that were sent to me - never received so I’m not sure if it’s a collection agency threatening me -

They just did the same to me. Im not sure either. I never received the papers they claimed and i have no debt on my credit report and haven't for 10 years. Guess ill just wait and see. This all seems fishy. I cant even pull up the name of the law office thats on top of the supposed letter they mailed me. I had them email a copy to me.

They sent SMS to my FATHER and me. This is a scam, if there is actual litigation you would have had USPS mail. Tax season is fraud season.

I was going to call the actual bank. They emailed me a "copy" of the letter with an actual account number. I had an account with that bank around the time they are saying but i know that information can be found pretty much anywhere. Its a reputable bank so that should finally set the record straight

They called my son's and my ex's numbers claiming that a civil lawsuit was going to be filed in my county and that papers were sent to an old address of mine.  Give me a freaking break.  I don't have any outstanding unpaid debt nor do I owe the IRS.   Desperate times bring out the ugly!!

These folks called several family members of mine calling looking for me by my maiden name which I haven't gone by in over 10 years. Claims to be regarding a Credit Card Account for "Carsons Dept Store" which I have never been to for a card opened in 2003 and last paid on in 2008. They had ALL my info; address, maiden name, last 4 of my social, my husbands phone number and 2 of my sisters phone numbers. I called Carsons Dept Store directly to confirm the Acct and they said they had nothing under my name and that they too thought it sounded like a SCAM. The gal on the phone got very rude once I said it sounded like a scam.

I can't find a law firm by that name or Stevens, Ellington and Associates.  Ellington and Associates is a Houston Defense law firm not engaged in collections.

Whenever someone tells you that they are a "lawyer" or that they work for a lawyer or law firm, the first question you should ask is what state(s) they are registered in and their BAR number for that/those state(s).  Then go to that state and check them out, contact them directly using the information in the state registration, as these crooks have been known to research real law firm names and attorney names and impersonate them.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1

Also file a complaint with your State Attorney General's office.

Just recieved a call asking if I received paperwork, when I said no they gave me another #866 991 1828 and when I called them "Ellington and assoc" the guy said I owed capital one from 10 years ago. I currently have 2 accounts with cap one so not sure why they would give me more credit if I owed them.
The guy had my last 4 of ss# Maiden name and married name, address and all. Said they would file a civil suit in my county. I told him we would see what the judge had to say then and asked him to mail me the notice again. He said the firm Sawyer group would do that.
Screams scan and I don't feel very confident that I'll receive and notice in the mail from them or the court systems at this point. Currently on hold to talk to capital one to confirm their practices of selling old debit

Called my phone anonymously trying to reach a relative and left a voicemail. Sounds like a shady debt collector or just another tax season scam............ “This message is for XXXXX, I’m calling on behalf of document control for Ellington and Associates. I’m reaching out on a notice of intent to advise you of a civil complaint they have with their office and due to no contact on your behalf, I would like to instruct you to give us a call back at 866-991-1828 and we have an account number with you and that is XXXXX. If you could, give us a call back and please be advised that if you do not contact the office, the office will go ahead and move forward without your participation or acknowledgement. Again, this message is for XXXXX.”

I don't think that Texas requires debt collectors to be licensed.  They do require a bond of around $10,000 if I remember correctly.

They say they are a law firm and they are required to be licensed in whatever state they are trying to collect from. They also have to have a surety bond of $10,000 in that state in order to work. I'm in Texas and they are in Atlanta.

These yodels are ambulance chasers. They get ancient information on uncollected debt - names and location pretty much are the only bits of private info they can get. They do a search to see if they can locate the person, sometimes contacting listed possible relatives, and give a phony case number to make a "Civil" action sound legit. Tell them to go cram it. They have zero authority. Do not interact or ask them for documents!
