- Concerned| 4 repliesI received a credit alert that I had a change to my credit report. The alert says that Adam J Katz PA ran a credit check for an "installment loan". I haven't applied for one, also, why would anyone attorney be giving an installment loan?? So after reading these posts I'm very concerned who had my info and why are they trying to open accounts on my name??? Beware all, check your credit to see if he pulled yours as well!

- BigA replies to ConcernedIt is possible that your name was sold to a debt buyer. Many times people are on those lists mistakenly. This outfit seems to have a bad track record, the attorney has been disciplined, although I can't tell for what. I would expect a call from these crooks. Do not fall for their threats. Make them follow the law, and when they can't do that , sue them.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Then:
You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter (think of it as the best $6.47 you ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. I can’t find a registration with the Florida Dept. of State or a collections license under that company name. This would preclude them from legally doing business or collecting in Florida.

It is simply too easy for unauthorized credit inquiries to be made by people who have no legitimate reason to be making those inquiries.

Then and she proceeds to tell me that she. Has 2 daughters who had kids n blah blah blah n i needed to make some king of arrangement now. Well why does one say can't do it and another wants to call an harass. I also told them do not call my husbands work as he will lose his job. Well Tina called in order my cell my house my husbands employer n i called her back n started to flip out , she hung up on me .lol. However I returned it by calling Carol back n told her which she claims they will be sending it out to file charges . go ahead. Its for 2370. 00 take me to a majestrate . idc. Called my attorney. All I had to say was the name Katz and he said they're scumbag debt collectors just trying to get me to call them back. He's very familiar with them. He's gonna call them on Monday and put the fear of god into them.i will update everyone reading this come Tuesday.
