- angered| 1 replyThey called me last week stating I had a loan, which I did at one point. It's been paid off. That'll teach me to ever do that again. These people keep telling me I owe more than 2x what I borrowed and must give them at least $100 now to stop action. I asked them to send me something in writing to prove this is legitimate. He said they'd send me something to my house and my email. 5 days later I've not gotten an email or anything to my house, yet some guy keeps calling me from a blocked number telling me that I've had ample time to respond to the charges and this is my "last warning." He says he'll serve me at my place of employment. Sigh. So I called the company again and asked why I'd not received something in writing and he says that he has to rely on someone else to send that out. I told him that he needs to call off his harassing phone calls until I get something in writing, but again, that's "of course" out of his control. Once the process of serving me has started then he can't stop it. I told him that I was going to call the loan company to confirm all this is legitimate, knowing I've paid it off. He said he'd do that for me. Then went on and on about how legitimate they are, been in business for 16 years, yada yada.... I told him that if he expects me to give him money he needs to provide me with something in writing to my house, not just email (which I haven't gotten again), and I need to confirm personally that all this is legit. He said he'll handle it and looks forward to speaking with me again. I suppose if I ever hear from them again I'll remind them that I legally am obligated to see something in writing from them 30 days before they do anything in the courts yada yada, better bone up on the law. I told them to stop harassing me. Don't they have to?

If they continue to bother you, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the [***] are working out of now.

- CatarinaMy actual phone call was similar, but the number given was 877-266-2785. The person states her name is Ann Davenport and went so far as to call a former sister in law that retained my last name but has NOTHING to do with me. I assume this is purely to attempt to "scare" me or defame me in some way. When I did speak to the scamster goddess (or maybe evil incarnate), she proceeds to tell me that I am subject to some sort of collection attempt and that the people in her firm (I think she was implying law firm, but actually scamatorium) were going to locate and verify my address. She said something about coming to the home like some of you all have indicated that they would do and that I would be subject to having my wages garnished and some other hard to understand threats. First off, I happen to be in law school as we speak. Fundamentally, you all MUST know that we have something called DUE PROCESS. Just because somebody says they are going to do something, doesn't mean they can. They have to file papers in a legit court of law and you have to have knowledge about this action (they have serve you). On top of that, you are allowed a minimum of 20 days to respond. Now, I do not have any outstanding debts. I didn't transact any short-term loans and feel wholeheartedly that this is a case of mistaken identity or my ex-boyfriend may have entangled me in one of his bogus deals and I only digress to let you all know that it is precisely WHY we have due process. We have the opportunity to state our own case and possibly pursue affirmative defenses. In the consumer world there is BBB and in your state there is a financial services department that can assist you. Most of the time there are online claim forms you can process right over the internet and they will investigate. On it's base, I don't think you have to be scared and certainly do NOT provide banking information or other personal identifiers. This is exceptionally annoying and the call comes in on my line as "unknown" so I can't block it, but taking no action is ACTION. If they really do intend to act on a consumer debt, they need to inform you in writing and allow you the opportunity to ask for a review of the alleged debt. To go to such great lengths as to sue you is costly to the business and also a very premature step. There was some vague acqusation of "fraud" and they also knew my bank (but not an account that belongs to me). I apologize for the long post but I am disgusted that people get away with these tactics. Final thought -- there is NO legal reason any one needs to come to your door. That should tip us off. Be well and be merry! Please also do not stress!! If you owe on a debt, you have rights too.
