    Earlier today, my mother received a call asking for me. This in itself was odd, since I haven't lived at that address in years, and have lived on the other side of the country since moving out. Now, the call scared her; they said that I have a bench warrant, that they've attempted to make contact, and I'm being sued. They gave her a docket number and said I need to call them within the hour or they'll attempt to serve me papers again. She said she wasn't sure if she could get ahold of me within the hour, and the man on the phone said that he would have them wait a while longer to serve me. That set off red flags for her, but they made it seem like they were calling from a courthouse. They gave her a number for me to call and the docket number, and made it seem it was imperitive I call asap.

    The representative claimed to be Mr. Alexander of AFG Associates.
    Upon research, I found that this stood for Allied Financial Group.
    When searching, I found the number under lists of repetitive-calling bill collectors, making idle threats, and always claiming such outlandish things. I'm assuming that a true legal authority would not be making such calls.
    they claimed to be representing Kay Jewelers, with whom I had an old bill for about $200 that I ceased paying after they refused to fix a piece or refund a piece of jewelry that I had purchased a protection plan for. Regardless, sure, it's my fault for not paying; it was not a way to get back at them. This was for more than three years ago.

    When I spoke with this gentleman, the red flags went up again. When I asked about this matter appearing on background checks, he went off to describe at length how it will better my credit score. (Great; but that's not what I was asking.) He seemed most interested in me "making payments to assure this did not go to court," which again, sounds fishy since legal representation WANTS to go to court and get their fees paid, as opposed to parties settling things out of court and on their own.

    I got a phone call from someone supposedly with my local clerk of courts. They were calling to inform me that I was about to be served. I was confused because I could not think of any reason I would be served. Also it was suprising that they were giving a warning of the action. He said I could call 877-800-1269 to have the "service" changed to a different date and time. I called that number and was helped by a Frank Arellano. He said that I was about to be sued in a civil lawsuit by an old credit card company, one which I was pretty sure I had settled with 2 years ago. He wanted me to make payment to him by the next day or he said I would be sued. I got the funds together, thinking I did in fact owe this. However I was not able to get my debit card info to him by the deadline he had provided. Now today is Friday and I was told if it was not paid by Wednesday that I would be served. Yet I have not heard anything else.

    At the advice of my father I began researching this and have found mulitple links indicating that this company, AFG & Associates, is a fraudulent comany. Now I am at a loss for the next step. I do not want to pay them if they are scam artist. However I also don't want to not pay them and get sued....

    Call your local clerk of courts.  Look up the phone number in your local phone book or in the on-line version of your phone book.  Ask them if you are being sued.  

    Do not give your credit card or debit card or bank account to anyone.  

    I'm 99% sure the call is a scam.  Even if its real they might be able to take you to court but they can't have you arrested or thrown in jail.

    My parents called me completely freaked out because I received a call from this number while at work. They told them they were calling from court and that I needed to show up, they gave them a case number and said I had to call back. I called back while at work and they said they were calling from an unspecified courthouse and I was being sued. I was scared and said I didn't know what this was about but I wanted to resolve this before going to court. He said I owed $1500 but that I could make a lump sum of $500 this month and that it would show my account as settled. However, he said I had to use a credit or debit card and that if I didn't do this by tomorrow I would be sued. I told them I'd call them back with my bank information but after my initial shock I realized I was about to pay these people for a debt I don't even remember having! They called me back from a blocked number and left me a message saying that I'd have till noon tomorrow or else they'd continue the process. However when they left the message they said they were AFG and Associates. So my question is who the hell are these people? Are they from an actual court or are they debt collectors?! Are they allowed to impersonate a courthouse in order to make me pay them? I called and left them a message telling them I want a mailed copy of whatever I owe before I make any payment. Help! I'm confused and scared.

    No! This is a third party collection agency and they have broken State and Federal laws by misrepresenting themselves as officers of the court and threatening to take legal action which is not intended or illegal:

    § 807.  False or misleading representations  [15 USC 1962e]

    A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

    --The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.

    --The threat to take any action that cannot legally be taken or that is not intended to be taken.

    Don't call them back again. Do everything in writing, including the demand they validate the debt they are calling about. This is the law! No validation, no money! Per the Fair Debt Collection Practices Act (FDCPA) they have five days to respond:

    809.  Validation of debts   [15 USC 1692g]

    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing --

    (1) the amount of the debt;

    (2) the name of the creditor to whom the debt is owed;

    (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

    (4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and

    (5) a statement that, upon the consumer's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor.

    (b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

    (c) The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer.

    Send your letter VIA certified mail with return receipt requested and keep copies of everything. If they continue harassing you, ding your credit or attempt to sue you without first validating that you legally owe this debt, you can take them to court and sue them for statuatory damages. Here is a good example to use. Just fill in the blanks:

    I got a phone call to day from a Ms. Calmacall with AFG & Associates, who said that they had a claim come into her office in regards to myself and my property and that she had made serveral attempts to contact me at work but I have been out of work since September 2010.  She also said she was tryng to contact my attorney who is representing me in this matter.  First of all I have not heard from anyone or have not gotten any certified letters from my mortgage company in regards to my home.  I am working with them to modify my mortgage payments but the letter I recieved was asking for me to send them two copies of my last bank statement to complete my application.  I don't believe that this is in regards to my home but maybe one of my past depts I had.  I will seek the advice of Alfalfa and write them a letter.  Thanks.

    Joe Alexander from AFG & Associates  reverse directory showed number 877 800 1269 was invalid.      Said he was a clerk of the court collecting a debit from X Company and was going to send a police officer out to serve with papers.  Gave a case number.  Called the number back and gave case number, phone was not answered as a business just a person's name & non-professional music was playing.... could hear people talking in back ground. Said that police from another county were going to serve me in my new county.  While he is talking about this, I found this website and I read to him that the web was saying that this was a fraudulent company and then I hung up.

    They called a phone number that I do not have linked to my name but could be reached on yesterday(a friends phone). I returned the call as a *67 and it goes to a recording asking to leave the case #, name and call back number. Must not be terribly urgent because they haven't returned my call. Of course I just opened my self up for more contact from them by giving them my cell phone number but I'd like to find out what the deal is with this because its pretty unprofessional the information they give out to someone over the phone.

    I'd be more than happy to settle something if they had sent me any paper work at all. I do not recall ever seeing the AFG name on anything coming through the mail. In both phone calls the person never specified they were trying to collect a debt or who they were with.

    I got a call from AFG and Associates saying they were from the county clerk's office and wanted to serve me with a court summons in the morning and that they had already sent me a notification by mail thirty days ago. I called the number,,877-800-1289 and was told they were in Califorinia and asked me to hold the line. IU held the long distance line for 10-15 minutes and they never answered the [hone again.

    I admit I fell for this. I am in the process of paying off all my debts and I received a call at my work stating they were on their way to serve me. I gave up information that I never should have. I just wanted to get this taken care of. At this point what can I do? Cancel my card? The man stated he was an attorney. Help me please.

    Got a call from them asking for my first name with my maiden and last name i had from a previous marriage. they were looking for my husband with the first name of my current husband mixed with the last name of my ex husband, at my current address with my current phone number. RED FLAGS!! lol
    My husband called today with the docket number they left and told them they had all the info mixed up. I'm SURE they're collectors looking for my ex husband. lol

    I have recieved messages from AFG Associates demanding that I call them back or have my attorney call them regarding my residency but don't give me any other information.  My mortgage company does not know what they are talking about, I really don't appreciate getting threats by people or company's who don't know what is going on.  I have sent them a certified letter, asking them to stop.

    A MAN CALLED FROM AFG SAYING HE WAS AN ATTORNEY AND HE HAD A SEVER ON HIS WAY TO MY JOB TO SERVE ME PAPERS.UN LESS I GAVE HIM MY DEBIT CARD NUMBER AND PAY HIM $1000 BY THE END OF THIS MONTH FOR A CREDIT DEBT.

    Mr. Flores of AFG Associates leaved a message to my husband instructing him to tell me or my attorney to call him back on this number (877-800-1269) regarding my home address which he never mentioned what is the problem, Instead of calling him I did research on the web about the company he is representing and I found out about this site.  Thanks God i found this site before I call him back.

    I received a call from someone a week ago, from a blocked number saying he was an officer of the court, and they had been trying to serve me a summons to appear in court. He said he had a court officer scheduled to make one last attempt to serve me, between 2-4 pm that day. No one showed up then or since. Today I had a message on my phone From a Mr. Castillo, from AFG associates, saying he was calling regarding a file on his desk, and wanting to verify my property. He said it was very important that myself or my attorney return his call immediately to stop court action. I checked with the courts here, and there is no record of action involving me. What the hell is this! Red Flags are going up big-time now!. I'm glad I looked up AFG associates and found this thread! The return number he left was 877-800-1269.
