I work in collections and knew their wording well, so I asked for a VOD (verification of debt) to be sent through email and a hard copy through my mail - I gave both a current address and email address - to see if they're a legit company. Weeks. I have waited WEEKS for them to send me something. Instead, they've called me late at night multiple times in a row. All I'm saying is that their tactics are sheisty. Ask them what their other aliases are and watch them scramble.

- Tamianth replies to SamanthaIn a word, Yes! If you didn't have a student loan, then they are taking money from you because they think you are the person they are really looking for. Debt collectors are notorious for calling people with the same & like names. The law requires them to prove you are that person. But DC's are infamous for not following the FDCPA laws. Portfolio is a prime example of this skip tracing..
And yes, even if its a government student loan, they still have to follow the FDCPA laws.

*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Results of FTC Complaint
The penalties that NCO Financial faced as a result of the FTC complaint came in at a steep $3.2 million civil penalty. This became the largest penalty amount ever obtained by the FTC against a third party debt collector. This giant penalty amount also came with an agreement from Expert Global Solutions (NCO Financial) and its subsidiaries to stop harassing consumers and using abusive collection tactics that are against the law. If they violate the FDCPA at any time within 5 years after the complaint was filed (July 8, 2013) each violation will be looked at as a separate violation from those listed in the complaint, and will result in more monetary penalties to be paid by the collection agency.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
