- laura| 1 replyjds recovery called me in an attempt to make a collection. I do however owe money and I know this. I literally forgot about this its been about 6 years. I went to the store its self to find out how much I owe exactly and they told me 180.00 dollars. when this jds recovery called me they told me I owe 800.00 dollars and asked if I had anyone that would help me pay this and I could pay them back, they sais, I was going to go to jail it was a pre-legal matter, then they send me a letter and the amount of the letter said 180.00... so confused I called them fully ready to make this payment, when they told me this letter was now void and they cant do that, therefore they were scamming me into calling them again I assume. right? I also asked if there was a way I could send a money order to them, they told me "if we just let anyone person do this I wouldn't be able to pay my power bill here at the office, or have a job" in there exact words.... that doesn't seem very professional at all to me. they wouldn't give me any information on where to send anything too except that I needed a bank account or a green dot card to make a payment. I want to know if this is legit and how come the store is telling me one thing and the jds recovery is telling me another. I know I owe money and I am willing to pay it just not over the phone or through my bank account no body but me had that information. is this legit?

- SidneyThey called my father in laws and left a nasty message on his answering machine saying that they have been trying to reach my husband to serve him court papers and they pulled up his social to get his number. That they would be going to his place of business to serve him the court papers. 1) that is total BS a legit company cannot call other people that are not you and leave messages like this. 2) they cannot threaten you garnishment of wages, say that you are going to be arrested, say they are a lawyer or serving with court papers and it goes on and on. This is how you can tell they are just your average debt collector that is so desperate to get u for money. They can be very low and nasty, but don't worry they cant do anything. A lot of times you will start to get calls when its about that time that ur debts will be wiped from your credit report. Check your states statue of limitations to see how many years it is for a debt to be wiped off. Most are 7yrs. I do feel bad for some people like the elderly, cause if you are innocent minded and don't know the tricks of these a**holes they can be very scary. The best thing u can do if they call is NEVER recognize the debt to them unless you know they are 100% legit. Once you acknowledge the debt they are talking to you about they can keep on u about it. Before you agree to them that yes I owe this and want to take care of it ask them who they are, where they are located and the name of who you are talking to. Any legit debt collector will give u all that info. Also ask them to send you the original copy of the debt, not a piece of paper from them that states what you owe. Cause obviously they have a little info about you and your debt from buying it for pennies on the dollar from the original place. Tell them you want the actual original debt that they are talking about. You can also which I highly recommend, call the place you owe and ask them if you can take care of the debt through them. More times then none anymore they will work with you to do that, this way you know 100% the debt you are paying off is going to the actual company and you can feel safe giving them ur CC info, checking account info. NEVER pay a debt collector with a money order of ANY kind. There have been many times where people have done this and the debt collector will act like they never got it and will continue to go after you about the debt. Oh and if they really did pull my husbands social they would have known where we lived, not have to call his father lol these people crack me up! The number that called was 1-877-544-4294

These payday loans you scumbags never pay back have extremely high interest rates so the balances are astronomical by the time they get to the 3rd or 4th collection agency. And the bounced check issue is because your original repayment method that was agreed to when you took the loan was an ACH (electronic CHECK) to be drafted for the amount borrowed plus the agreed upon interest. When you scumbags intentionally close your bank accounts....the check bounces/gets returned. Most of the payday lenders are based out of Florida. Feel free to check FL state laws on bad checks, it states that if you intentionally (which the payday lender[s] are left to assume it was intentional) present a check/ACH draft out of a closed account that exceeds $150 it can be charged as a B misdemeanor = maximum punishment 60 DAYS IN JAIL + $500 FINE.

Since you clearly cannot or did not read most of these posts, many of the calls were not for the people posting here. And one of them asking for payment by a Greet Dot money card -- a clear sign of a scam. I encourage you to feel free to check the law -- the FDCPA -- that has been violated many times as reported in the above posts. At no time do any of the posters say they received in the mail any debt validation letter (required by law). Further, any threats of arrest are bogus, and threats of lawsuits that are not followed up on are also illegal.

It simply means that they don't have it and they are relying on threats to make people pay. Many 3rd rate (or less) collections companies will use this method, not just Scammers.

Your claims concerning Checks are completely irrelevant and completely incorrect for too many reasons to go into here. Florida laws, even if applicable, are only applicable in Florida. PDLs are illegal in many states and the firms that deal in them know that..and don't care. A loan is a civil matter and regardless of how many of you minimum wage scumbags come on here threatening 'jail time' it is not going to happen. Never has, never will.
PDLs are a scam from the get go. The people giving them are nothing but barely legalised con-artists and the people trying to collect on them are outright frauds with big mouths and low IQs. Ignore them or find a consumer Attorney. Once a collector understands that you're not a fool and are not in the slightest bit intimidated by their bluff and bluster they will move on to the next target.
If you owe a debt, pay it. That will help the rest of us who don't owe debts finally put the last nail in the coffin and bury the bogus and 3rd party debt collection industry in a deep grave. - dave replies to lauraHow could you just forget about a debt for six years? First off, I think I would go back to the lender and see if I could make an arrangement to settle the debt with them. Never admit liability to any collections company over the phone because they probably have nothing to validate the debt anyway. Sounds like this debt should be out of Statute of Limitations. Check your state laws concerning statute of limitations. In many cases, admitting liability resets the clock on this. However, if the statute of limitations does apply, the debt is legally uncollectable. I would bet that the Original lender has already written off the debt and the collector is a buyer of old outdated debts and trying to collect Big dollars for what they purchased for pennies.
Incidentally, most payday loans carry an interest rate of up to 400%. I wouldn't send any debt settlement to anyone via green dot or any similar payment. This is a scam as my bank would have contacted me regarding any fraudulent charges. Plus, I always reconcile my bank statements immediately upon receipt. They identified themselves as JDS Legal Services.
