- D.Called landline today. Our home phone system has a voice-ID function to identify incoming calls aloud while the phone is still ringing, but for some reason this call did not trigger it. I picked up and heard what others have reported: just a male robo-voice repeating a reference number. Caller ID on the phone reads CAPITAL RECOVERY, but the message gave no such identifying information.

I decided to call back, since people have complained here about very persistent calls from them. They were calling about a parking ticket from a small city I visited in 2016, where received a $40 parking ticket. I had paid that ticket in full a year or so later after I got a dunning notice from the city. The man I spoke with at CR said he would contact the local office in question and if they could confirm it had been paid I would hear no more about it.- Caller: CAPITAL RECOVERY

- BigA replies to Edward Shaw| 1 replySo, where did you come up with that fantasy. First collection agencies work on commission. They get 30 to 50% of what they collect. So it doesn't matter how many times they call they don't get paid extra. Now in what is probably this case either they bought the debt or they are making it up. In either case there is no "client". I don't know what the phone companies have to do with it but way back in 1977 the Federal Government passed the Fair Debt Collection Practices Act. Every state has collection laws as well so where is it that the legislators are providing "cooperation"? The Federal Government has also provide you with the Federal Trade Commission and the Consumer Financial Protection Bureau who work in conjuction with the Department of Justice. Every State and Commonwealth also has an Attorney General to protect your interests. Simply because you never heard of these agencies does not mean that law enforcement is rendering "cooperation". Maybe you should use the internet to learn instead of spouting off nonsense?

- BigAYou will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it. Some people have indicated that they are collecting for traffic fines, etc. Please note that the following does not apply in those circumstances.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

Since unwanted calls are endemic, why don't I just stick with my answering machine pickup on the second ring, a two second message before the tone, and what amounts to perfect call screening once people get used to it.
