- Rafael| 3 repliesYea....it's RFA aka Reliant Financial Associates of 501 N Golden Circle Drive - Suite 210
Santa Ana CA 92705. They are scam zombie debt collectors. Google this number 866-764-9779 to read all about them and their illegal ways (spoofing caller ID of your local law enforcement, pretending to be lawyers, claiming to have filed a lawsuit against, threatening to embarass you by showing up at your work).
They hope you'll be scared enough to give them your debit card and make a payment on your expired debt - which effectively starts the clock running again. Don't do it...don't fall for them.
They are required by federal law to VALIDATE your debt in writing. They never will/do. - Bianca replies to Rafael| 2 repliesThey called me yesterday with a threatening phone call; Andrew Taylor, as he said his name was, was telling me that someone had filed a complaint against me and that he was a litigator. He also said that if I choose to set up a payment plan with him, he would help me get the BEST payment option available. He literally demanded my debit card information from me. This is a scam! As the person said prior to me, the try and collect on old debts, and once one makes even $0.50 payment, it will reactivate the debt again, therefore making the debt active for another 4 or 5 years, depending on your state's statute of limitation (SOL) and legal to collect on. Andrew Taylor has also said that they would garnish my wages, and on top of everything, was able to tell me about my entire life history! I have spent the 24 hours researching these "people" and this is what I have found. Click on the link below and see what I was able to research; it's shocking. Please do not pay whatever he says you owe. If you feel that you are being harassed, file a complaint with the Federal Trade Commission and do not answer the call.

- Brad replies to johnathenYour full of BS johnathen. real people don't talk like that - the debt "fell off my cbr" Only debt collectors talk like that. Your one of em.
- anonymous replies to ANNEMARIELegit collectors per section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint.
Be aware that scammers are using bought/hacked/phished loan application data to extort payments for fictitious debts from victims and victims' families and friends.
