Despite Txting “Stop2Stop” in every way, shape and form, they continuously bombard my cell. I have spoken with them, explaining to them that I am NOT the person they are seeking and requested my number be removed, they still txt. I have blocked all of the numerous numbers they use to txt from and still, the harassment continues.
I just spoke with a “supervisor” who admitted that I have called a number of times and (yes, I refused to give my name because it’s none of their business) when I raised my voice to explain that my calls were to have my number removed, he offered to end the call because I was being rude. Not one expletive flew out if my mouth but I did raise my voice because it is rather difficult to be heard when the party on the other line won’t shut up.- Caller: SP

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

Hello, I received a message just like this and have been for months now, so I decided to give them a call. once I made it threw after several attempts they told me they were a debt collection agency and were trying to collect a debt in my husbands name from CashLand. They knew the amount of the debt and both of our names. I told them that we had paid that debt off months ago, they insisted that we hadnt paid it off and needed to send proof of payment to them to a fax line or an email address that had a strange address that ended in inc.co. Once they told me I needed to provide proof of payment I told them I wouldn't be giving out any sensitive information to them until they provided me with an itemized proof of debt. I also asked them what they considered proof of payment and they told me that they would only accept the loan closing paperwork and they wouldn't accept a receipt or our bank account payment. the proceeded to tell me that they wouldn't be doing that until I gave them the proof of payment. they then told me that since I made statements such as we paid and we made a payment that I was assuming responsibility for the debt and I told them I didnt think that or the failure to provide me with proof of debt would hold up in court. they began saying at this point they would be hanging up and I asked if they were unwilling to work with me on the matter and they hung up the phone.
Do they have to prove debt and if they don't am I forgiven. should I peruse this any further? cashland says that they did turn us over to a debt collector but once we had taken care of it they removed us from the list for the debt collector. - BigA replies to Steve| 3 repliesYou can repost but my response stays the same.
