Along with the letter and complaints stated above.  Send a certified letter to Drive Financial and Santander Consumer.  Make sure you send this certified where they sign for it.

State that you are unable to take calls at your employment.  If they continue to call, you have proof that you alerted them not to call at work.

These people called my cell phone number twice and asked for someone who is known to me but not relation. Today they called my home phone...When I tried to investigate how they had my number she said the man who they asked for must have filled it out on his loan application. She hung up on me. She muffles her name, something like shadon...and I could only hear _____ ______ USA for the company name.

This is Drive Financial or Stantander (depending on which name pops up w/ the number).  My husband has already made payment arrangements and talked to 7 different reps.  They know they will get their payment and we have always met the deadline.  When they call on this number there is nothing but dead air and if they use the 214-450-0714 number they ask for him by name.  They also repeatedly call even though I tell them what time he will be home.  They call as early as 7:30am and as late as 11:15pm.  SO annoying we are only 3 days late!

This company is calling a friend of mine's cell phone looking for me and telling them that I had given them their number as a reference number to call them!  Thats a load of crap!  I don't remember giving out anyone's number!  You have to list someone on the loan ap who doesn't live with you to verify who I am but never did I give any permission for them to start harrassing my friends!

Next time they call cite the Fair Debt Collection Practices Act to them. It states that they can't call you before 8am or after 8pm. It also states that if you notify them in writing that they can't call you at your place of employment, they have to honor it. Make sure you send the letter certified return receipt requested so you have proof they received it. Google Fair Debt Collection Practices Act. It will tell you what is legal and what is not. When you throw that out to a collector, they back off real quick.

These people call 4-5 times a day to a suicide prevention hotline and when told to stop they want full information on the person calling or they will keep calling.  They do not care at all if they block someone from getting through that needs help.

Actually it's not more than ONE call per day allowed to a #, whether it's an "attempt" or actual conversation.  The onlly exception is if you talk to them and give them permission to call you back later that day.

    Well, several problems here ..

First, debt collecotrs, unlike telemarketers, do NOT use "predictive dialers", since each debt is individualized (e.g. different amounts, sometimes owed to different creditors).  They have to be able to respond if a person picks up.  Hence that is why devices like the Telezapper do not work with creditor calls, unfortunately ..

As to the National Do Not Call Registry (and the TX Registry), there are exceptions for calls from creditors, collection agencies, or anyone with whom the listed # has had a previous biz relationshiip.  So putting your name on the list won't stop collection calls.

Third, although Greg Abbott is doing a good job in office, his office will usually seek injunctive relief (i.e. get a court order requiring that a co. stop abusive practices) under the collection and DTPA laws only if enough consumers complain about a particular harrassive collection co. to his office to make it worth his agency's time.

One thing to do if you are in TX is to check with the Att General's office's website to make sure the collection agency is licensed and bonded to do collection work.  Otherwise, they are operating in violation of the law (you'd be surprised how many aren't licensed).  That fact makes it more likely the AG will take action against that company, plus it's good ammo to use against them next time the collection agency calls you!

Collection agencies are pretty bad about that, as they don't know if the person answering is really the debtor and lying to them.  The best thing you can do is go up through the chain of command while you have them on the phone until you talk to a supervisor and make them understand that you are NOT the person they are calling for and demand the removal of your # from their system.  Tell them how long you have had the phone #, in case the debtor may have had your # before you did.   That should help convince them.   (btw, despite anything the caller says, you do NOT have to prove to them you are not the debtor --  THEY have that duty, as they are taking the risk of violating the collection laws by continuing to call someone who has apprised them they are not them!)

A company called santander bought vehicle loans from several different lenders .Chances are if you bought a vehicle from a dealership and let the dealership get you financing they could very well now own your loan.

Santander Consumer USA has taken over for a large number of Auto Financing Companies.  Citifinacial Auto is one of them.  If they are calling... it is to either update account info, or because a payment is late.
