    Got a call from this number threatening legal action/law suit if my husband did return call immediately. They said something about trying to serve him papers and if they couldn't get him they would file suit. They also left a case reference number for us to use when we called them. I called, they claim that they are Allied Financial...and are trying to "get to the bottom of the situation regarding my husband and asked me to verify his DOB and they would give me the last four of his social. I said no!

    So you'd take the word of some stranger that you owe them money - without physical proof that they own the debt and have the right to collect it?

    They DID email me proof of the debt (which i know i owe), they're registered with the Sec. of State, with no logged complaints. The debt is legit, they've satisfied me they're legit. I still dont know how im getting scammed?!?
    if so, i wish someone would point it out more clearly.

    Okay. I'll be more than happy to point out the problems here. They are REQUIRED to MAIL you a notice of validation within 5 business days after initial contact with you concerning this supposed debt. Did they do so? No? I thought not. They are REQUIRED to provide you with a verifiable physical address. Did they do so? I thought not. You state they're registered with a Sec. of State. Please supply us with that info. We're extremely good at research here. BTW, those "complaints" would be handy too. Those I'd love to see! The E-mail you've received? Well, that is proof of NOTHING! I think you already know that. You just didn't expect us to catch on to that one so quickly.
    I think you know where I'm going with this "Trisha". Just as you know that you don't want to screw around with me "Trisha". Bogus/Fraudulent debt collectors don't fare well here "Trisha".

    I called the 888 number after getting a couple of calls on my Gov't. cell phone (unlisted) regarding a family member in another state. When they finally answered a woman answered with "Corporate Office" I asked what corp? She told me she answers the phone for many corporations, did I have a case or file number? I explained to her that I was calling from a US DoD Communications office (where I really work!) and I'd like to speak to a supervisor. I was put on hold and after 3 or 4 minutes was dis-connected. I really hope they were trying to use any kind of caller ID.....they will be surprised at what it tells them.
    Anyways........this has got to be a SCAM!!!!!!! I'm sure it's some kind of scare 'em into paying a fine or debt BS tactic. Idiots!!!!!!

    Well, not sure why your so defensive "GUNNER", but it seems you're not paying attention....
    No, they did not mail me a notice after contacting me, email, as i previously wrote. However i am getting a paid & validation in the mail after i pay. Again, I am aware of this debt, and know i owe. it just caught up to me.
    They DID provide me with their name, location and the direct phone # of the person handling my case, are American Financial Solutions, on Van Karmen, Irvine, CA. You can do your own Sec.of State research since you're so go at it.
    And again, re: the 'complaints", i previously wrote there are NONE!!...NONE. Meaning there are NONE. So, what complaints are you wanting to see?
    It's a shame, i stumbled upon this sight (based on ph#), looking for help, instead I get other debtors trying to justify not paying their own debts..
    Good luck with that GUNNER.

    Neither phone, fax,text or email is valid proof of a debt owed.

    Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
    "§ 809. Validation of debts
    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
    (4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
    (5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

    ***A company must be licensed in their state as well as the one they are trying to collect in if two different states are involved.

    Some Tips:
    *Keep all messages
    *Take a picture of your Caller ID
    *Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
    *Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
    *Check your SOL for your state as well.
    *Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

    Extortion Scam Related to Delinquent Payday Loans

    Washington, D.C.
    December 07, 2010  FBI National Press Office
    (202) 324-3691

    — filed under: Press Release

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.
