    I got a call from a person saying they were calling about serving papers from Morse and Baliey law firm. No firm located. Plus when my lawyer called they cussed him out and hang up on him.

    Got a voicemail to sign paperwork as well, called back and stated i had a court date due to medical debt in collections, hung up, called back again and rep couldnt tell me what the debt was for and that there wasnt a court date, never received any official letters for this. Not adding up and no knowledge of this debt

    They left a voicemail, I Called back and  told them I don’t even know a Bonnie and they asked if I was first, middle, last name, I said not in over 15 years. They said I was playing games, I said no, I don’t know who you’re looking for and remove my number. Apparently “Bonnie” don’t know me either cause if they used me as a contact, they’d know that hasn’t been my last name in over 15 years.  Needless to say I was pissed.

    The fake process server/location specialist scam usually contains:

    They mention that they have received a Fax document or that some sort of complaint has “come across my desk” and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

    Nobody has ever had to go to Court from a debt scam. If you are not sure if you owe or not, maybe read the post by BigA and use the links.

    It’s a scam. So at first I got a voicemail that some paperwork was to be sent certified mail and that I’d be notified. So I waited, no paperwork came, and I was home. I forgot about it to be honest. Then they started calling my family members, my daughter, my mom, my brother, claiming that documents were sent to me.  Never happened so I did not respond because it sounded like a scam. Finally they called by SIL, which was very annoying—I did not appreciate whoever it was bugging my family. So I finally called, a very rude man told me that I had a medical bill from 2007 or something and that I should have gotten a certified letter blah blah. I told him I never received anything, and told him to send it to me again. He ignored me and said that they were going to garnish my wages. I said good luck with that because I am not working, and besides even if I had something from 2007 it’s past the statute of limitations. I said, Nope, I know the law and I know my rights. That’s when he started screaming at me about law changes BS that they were going to take my home and hung up on me. I had my lawyer call him and he just hung up on him. So… I am pretty sure they have stolen data from one of the many breeches, God only knows who else has our info. More scams to come I am sure! Be vigilant my friends!

    Of course it is a scam. Cute story ya made up, don't know why, like who is it supposed to impress.  When they said "garnish", you know they are bluffing because you have to first lose in Court. I highly doubt any 'lawyer' would waste time calling them about it even if some nitwit would pay for that.
    No, again, I highly doubt your 'data was stolen' in a breach, as most are 3rd party debt buyers.

    Bullying everyone, you say? That is what the trolls say when they have nothing to add to the "story", but instead try discrediting the person who pointed them out. I don't need to fact check when a fake story is obvious. I replied to one person and you're the one who replied to me seeking attention.

    That would be what I thought you might say, then the next part would be they either hate scammers and wanted to scambait or they didn't have anything better to do, so they were willing to do you a favor by finding out about the 'garnish' scare tactic, yeah many variations from such a story. Not sure why it matters that much you have to defend it or maybe you purposely replied to my post to initiate me flinging troll feed on the ground.  Either way, I think I made my point and the troll feed bag is closed.
