    Received a restricted call on my cell. Let it go to voice mail. James Smith left a message saying he needed a signature to avoid pending legal action. He left a docket number and said I had 24 hours to call 888-827-4056
    and talk to the financial institution who was initiating the legal action. Called number. Got voice mail for Kyle Anderson from Executive Credit Services. I was told to look for a process server at my "address" and work place.

    George, I had this exact same situation happen on the 12th, same names etc.  I've asked for copies previous letters they've mailed, proof of ownership of debt, neither of which they can provide. Asked if they would take bank checks as I won't provide my banking information (and that's how ive paid off a debt previously), they will only accept electronic transactions, but he suggested that I go get a gift card in the amount from CVS and I can process the payment that way...yeah, sure

    If they refuse to MAIL (only way)the proof...BLOCK THEM.  Then they would be doing mail fraud since they have NO proof.  The gift card payment is a SURE sign of a SCAM. (untraceable like cash).

    When I said they had the wrong number he started swearing at me saying f you. I hung up and he called back numerous times  using private number and swearing again don’t answer I’m sure it’s a scam.

    A person named James Smith called my house from an out of area # & said he calling regarding an address issue when I didn't give him information he hung up & 5 mins later I got a private call in my cell from the same person & hung up right away

    I received a call from this number and they left a voice mail with a case #.  Called back and received the voice mail of Kyle Anderson with instructions to leave my name, phone # and case #.  I looked up Executive Credit SErvices and I do not believe this caller is representing that company.

    Left me 2 voice mails this week stating she was Nicole Sanford, a case manager from Executive Services and they needed to hear back from me or my attorney regarding a civil complaint that was filed against me. They even gave me a case number to reference when I call back. It came from a private number which I never answer. I won't call back because I know I should have received something in the mail before receiving a call like this.

    Michelle Long left a voice mail, using my brother's first name, saying they have a complaint that needs my signature and they will come to my house and/or place of business. She left a case # and gave 24 hrs. to contact the filing party at the 888-827-4056 number. I didn't respond. There were 5 more blank voicemails afterwards.

    Received a call from one "Pat Crosanti" claiming that he was a "licensed courier" and had received a complaint in Kings County with a certain "docket number" and that I had now been formally warned that they would be delivering at my home/work place.  Unfortunately for "Mr. Crosanti," I was not only not the person he was looking for, I work for experienced litigators and am very familiar with how these things work.  For all those who have received this kind of call, please be aware that process servers who are actually filing legitimate complaints WILL NEVER CALL YOU to tell you you are being served.  What is more, your local county clerk will have a specific format re: how an actual filing number appears.  Don't be afraid to look this up on the court website or call the county clerk's office directly.  DO NOT BE BULLIED BY THESE CALLERS.  They are abusive debt collectors who, more often than not, are trying collect debts that you may have already paid and were not properly reported on your credit report, or debts that may now be too old for anyone to collect.  Additionally, phone calls are NOT acceptable notice for any legal filings.  Know your rights & don't be bullied!

    Major scam.  Make sure you check your credit report and that all old debts have been removed, just to be safe.  These guys are usually trying to collect either expired debts or debts you've already paid that weren't reported.  Even if they may be real, you don't have to take their crap.  They'll never call you first to tell you you're being served.  Be well!

    George posted here almost a year ago. I doubt that he will suddenly decide to stop back to answer you.

    The fake process server/location finder extortion attempt usually consists of the following:

    They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
