- Herb the pessimist replies to jay45These debt collectors get random debts from credit bureaus and then claim they are calling to collect a debt. They have no agent authority to collect any debts, and try to get you to settle with them, but once they get you to agree to their agreement, they hold you to a debt you don't owe. Remember debts cannot be collected by anyone who is not a party to that debt. If you don't have a signature to a debt, you don't have that debt. What you have is an assumed debt, and can only be collected with the permission from you. So don't give any information out to anyone by phone or internet, they use wire fraud because it is easier to hide their identity, but steal yours.

- JessI got a call from a different number last month mentioning Hudson Valley Collection Agency. They called and stating was message for name left blank saying they need to discuss a business matter. I called them back. The debt was for someone I've never heard of and I've had the same cell number for 10 years. The person snapped at me saying she'd take my number off the list. Not true they started calling again from different number this week. I doubt this a legit collection agency.

It is a recorded message that says it's a call from the Hudson Valley Collection Agency and it's an attempt to collect a debt. The recording does not list any name of who they are trying to contact or anything about the debt. They just leave the phone number to call them back 888-913-7405.

You need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

She cannot legally discuss the origin of the debt with anyone except the alleged debtor. She would then have to verify who you are. I don't see how student loans got into this conversation as I don't think that they have a contract to collect them. Most likely you failed to read the other posts as well so you left here clueless.

Debt validation letters must be requested in writing as per the FDCPA. The DC does not need to accept a verbal request. They must verify who they are talking to before discussing the alleged debt.
