BIG MISTAKE, I HAVE VERIFIED THROUGH THE LAW SOCIETY OF UPPER CANADA AND MY ONTARIO LEGAL DIRECTORY. These people are common collection agents, nothing more. I left a message for a Mr. Canning, indicating the next time he called me, I would be calling York Regional Police. Who I am sure would be very interested in them, given they are attempting to deceive people to believing they are legal professionals. I suggest to all, contact the Law Society of Upper Canada to notify them of the fraud/abuse and the York Regional Police of their calls.

I need to know the name of the company and if they are legally able to collect in British Columbia. If they are not then there are steps to take to prevent them from calling.

I checked as well with the Law Society of Ontario, they are not lawyers have no legal degree and was advised to file a complaint against them with the province on Ontario. They have violated every rule under the Collection Agencies Act but the legal one's they are breaking claiming to be an officer of the court.- Caller: Pomer & Canning

- LThese people are unbelievable, how dare they harrass and think they can get away with it. They called me at work, and started yelling at me, they did not identify themselves, they did misrepresent themselves as being a law firm, and threatened to guarnishee my wages. I have seen so many complaints on the net about them , i truly cannot understand how they remain in business. By now, they should have been shut down. What is the holdup? Life is hard enough, without having to deal with these unsolicited attacks. What kind of people can work in this environment, I certainly could not go home everynight satisfied if i did what they do. Palmer and Whatever, get yourself a real job and stop attacking the rest of us. Your pathetic.

- Misia| 1 replyThey keep harrassing my dad about some Canadian tire outstanding CC balance. They ask for totally someone else, and when my dad tells them they have the wrong number they go on with their stuff about lawyer etc, etc and yell at him. Although I'm not in the legal business, I'm familiar with the Collection Agency Act because of 407. I called the firm on behalf of my dad and told them to take his number of their harrasment list. I also advised that if my father receives one more call from their idiotic reps who lie about passing the bar, I will file charges with Peel Police and with the Law Society of Upper Canada and any other organization that comes to mind. A lady by the name of Iuba took the number of the list and said they were calling the wrong number. I told her that I will be forwarding the phone bill to them since they kept calling when my dad was out of province and out of country. She was actually quick to apologize.
Don't bother talking to the person calling. Call them back and tell them someone keeps harrassing you, and you don't even know their flipping name.

The only organization that can do that is the government (without any true explaining). The only time they will be able to do that is when you lose in court. The only thing you might want to check out is what affect they may have on your credit. Not all companies can affect your credit.

And the two partners in the law firm are indeed lawyers listed as in private practice.
There is also an incorporated business that uses the same name. Which they can do if the two law partners allow. This incorporated business describes itself as a collection agency with a difference. They mention while they have resorted to litigation, in most cases they "convince" people to settle out of court.
But despite their propaganda, it would seem they are just a mere mortal collection agency with two lawyers or more under their employ. This is actually very common among bigger collection agencies.
Is it something to worry about? Well do you care about your credit history? If you do and you think it's over something stupid or you think you are the victim of ID theft, then you should contact them immediately to get the particulars. But remember they will be deceptive as they legally can be.
For example they can say they are calling from the offices of a law firm. This just means they are calling from the building where the law firm's offices are. While it may imply that they are litigators, really they are not saying that. Another tactic they use is language which have social implications. For example, they can call your case file a docket number. Or they may even imply they are agents of the law. Like "We are calling a matter that may come to the attention of the RCMP"... Or the like.
Anyways, if you care about your credit get it straightened out. The best way if you suspect fraud, retain an ID theft lawyer. Have the lawyer contact the collection agency. That way you don't have to sift through the rude, intimidating or downright condescending attitude of a collector.
If you must call them without representation, then ask specific questions and record the call. Don't answer any of their questions which might be attempting to just fishing for more info. If they are calling you at work or on a common line that you share with non=family members let them know. Don't give them your cell number. They are NOT allowed to call you at work or call you on a line that belongs to someone else. So they can't call you on your downstairs neighbour's line. They can't call you on non-immediate family's lines either. So if you call you at your parents place just tell them to tell the jerks that you don't live there.
Bottom line is the reason collectors are such shady characters is because they are totally toothless in Canada. Repo men are illegal like bounty hunters. If a property with a lien is defaulted on, they have to go to court. They then have to get a court order to repossess the item. Then they can request a police escort to recover the item. At that point if you don't hand it over, it's theft. But prior to a court order they can't just come and take the item. Nor is it legal for them to break and enter on private property to collect the item without law enforcement presence.
Items without a lien can not be taken by a creditor without a specific court order to liquidate.
Also if you lack property and are heavily in debt, the threat of bankruptcy will usually make collectors less aggressive.
Also, if it does go to court an you really do have no means to pay, a judge will NOT push you past the poverty line with any wage garnishing. And it is very much true that only the government or a court order can result in wage garnishing. 90% of wage garnishings are the result of a divorce/child support case.
So do you have to pay them? Well legally yes, but not immediately. If your credit sucks and you don't have much need for good credit, save up and pay them off as soon as you can. But do it all at once. And get a written statement absolving you of the debt. Have a lawyer look it over. Then pay them. Or you might be stuck with some fees that have nothing to do with your debt. Worse than that some of these scum you take your cash to pay for their fees rather than the debt. They might even pass your debt on to another collection agency...
If you don't think you can ever pay them off, get a bankruptcy lawyer. Remember you are allowed to keep $33,000 of your assets to rebuild your life. But don't count on getting anything but a prepaid or deposit backed credit card in the next seven years.

He claims my wife and I had a payout from a Title insurance claim two years ago. I thought this was a scam as we received the pay out over two years ago. I will be reporting this call to the York Police Department and the Law Society of Ontario in the morning.

Thank you for the information, I just received a call from this number concerning an employee, I told her that we do not release any information on the telephone and certainly not to anyone without approval of that person. She immediately went into that she was a law firm and that a wage garnisment would happen on this employee, again I told her not to dial this number again as I would inform the police, she went into a rage, yelling that I didn't know who I was dealing with, I replied nor do you and hung up........I am contacting the Law Society.
