How can I verify whether or not a debt collector is legitimate?
Here are a few warning signs that could signal a debt collection scam:
The debt collector threatens you. Legitimate debt collectors probably won't claim that they'll have you arrested or claim that they or their employees are law enforcement officers.
The debt collector refuses to give you information about your debt or is trying to collect a debt you do not recognize. You have certain rights to ask a debt collector to verify the debt. You can use this sample letter to request this information. Ask for an explanation in writing before you pay.
The debt collector refuses to give you a mailing address or phone number.
The debt collector asks you for sensitive personal financial information. You should never provide anyone with your personal financial information unless you are sure they're legitimate.
If you think that a caller may be a fake debt collector:
Ask the caller for his or her name, company, street address, telephone number, and professional license number. Many states require debt collectors to be licensed. Check the information the caller provides you with your state officials, or the state in which the debt collector holds a license. If the caller refuses or is unable to provide you with information about his company, or if you can’t verify the information he provides, do not give money to the caller or company.
Tell the caller that you refuse to discuss any debt until you get a written "validation notice." This notice must include:
The amount of the debt
The name of the creditor you owe
A description of certain rights under the federal Fair Debt Collection Practices Act
If a caller refuses to give you all of this information, consider requesting this information in writing or seeking assistance before paying the debt to make sure the debt, and the company, are valid.
Tip: You can consider sending the collector a letter requesting the information by using one of the CFPB's sample letters. You can also submit a complaint to the CFPB or you can contact your state Attorney General’s office.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know the company or person you are talking with is a real debt collector. Scam artists, like fake debt collectors, can use your information to commit identity theft such as:
Charging your existing credit cards
Opening new credit card or checking accounts
Writing fraudulent checks
Taking out loans in your name
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Submit a complaint with the CFPB or get in touch with your state Attorney General's office with information about suspicious callers.
Stop speaking with the caller. If nothing else works and you believe the calls are fraudulent, send a letter demanding that the caller stop contacting you, and keep a copy for your files.
Tip: You can use this sample letter to write a letter demanding the debt collector stop contacting you. By law, real debt collectors must stop calling you if you ask them to in writing.
Tip: If you're having trouble with debt collection, you can submit a complaint with the CFPB online or by calling (855) 411-CFPB (2372).
http://www.consumerfinance.gov/ - ?? replies to Adam J.| 1 replyIf you called the original loan company, why didn't you just pay them?
- Badge714 replies to ??Because you can't. In the case of a (real) loan that has gone to collections, the original company has written off the debt. It's no longer on their books, it belongs to who bought, or was given, the debt.
- Gunnar replies to Adam J.Back again huh? Well then, here we go! You say you got a verification letter from them. Then simply post their return address right here, right now. Don't provide us with a UPS box number. Give us the address that was provided on those letters. If they were legitimate they would have a valid physical address on them. Legitimate firms won't provide anything but a valid physical address when communicating via the mail. It prevents legal problems downstream.
I don't see why you would have any objection to providing us with this outfits information. Except for the obvious reason of course. You're a Shill! A determined, but rather dim-witted Shill! Did you think that you wouldn't be called out again? Ooops, proof once again that your type is never hired for your intelligence.
Skeff Ett Liv!
Gunnar - Why replies to Adam J.would you go to all that trouble when it up to the DC to prove they own the debt and to prove that the debt is valid? They must send you a letter within 5 days of talking to you that says who and where they are and the alleged amount and original creditor. How did it get transferred through all these other debt collectors and you didn't receive one bit of correspondence or even a phone call?
Years ago, how many years ago? Possibly the debt was past the statute of limitations for your state? So many holes in your story. Typical of a company paid shill.
And then there is the question of why you looked up a phone number when you knew who it belonged to. - FU2 replies to bidjaybirdThank you, Captain Obvious.

- lmwe30 replies to MidNYteStorm| 4 repliesAre you a process server? Process servers will contact you by any means necessary. Why wouldn't they try to call you, most people freak out and end up folding and giving them money before they have to even go through the effort of driving around to past addresses looking for you.
- Alfalfa replies to lmwe30| 2 repliesThe following information is from a LICENSED Process Server in Florida:
An actual Process Server is not going to have any conversation with you about any debt you owe, nor will they demand payment from you. If something like this happens, immediately call local law enforcement and make a full report including as much descriptive information as you can give them of the person impersonating a court officer.

- MidNYteStorm replies to AlfalfaI could not help finding humor in the response by lmwe30. Obviously a legitimate doesn't call people. But of if Imwe30 wants to believe otherwise, then I will leave them to that dream.
- I call, "Bull.. Fecal Matter" replies to lmwe30No way. Not evah!
Process servers don't call to get someone to fold and pay up. They never call..
You better go back and take another read through you "Scammer's Handbook For Dummies". - Your post was very helpful replies to Julianna-in showing that we should never take the word of a shill for debt scammers.
- lmwe30 replies to AlfalfaI never said they would DEMAND money from you. I also never said this particular number is not a scam. Call an attorney in any area, they will tell you that the process server if out of options to try to reach you, ie. gated community, person moved around a lot, away for school, will attempt to call you and set up a time. Some procerss servers charge per attempt others a flat fee for a certain number of attempts. When you have no luck as a process server after 5 attempts the attorney is going to be unhappy, you will do what you need to do.
Like I said, they will never demand money from you, they are a impartial party however they are known to call you, so do not just ignore it, do a little more research through your SOS and find out some information about the company claiming you owe money.
Below is a link from a trusted attorney community stating from three separate attorneys that it is not uncommon for a process server to attempt to call you to set up a time to receive the papers.

- MJG replies to Damienne Orthmann| 1 replyYou are not warned if a summons is coming. If they call again, demand written proof of this "problem" that is mailed to you (original creditor, dates, charges, etc.). That would be official notification - phone calls & emails are NOT official. Expect excuses and possibly illegal threats. Their city is very close to Buffalo, New York - home of many bottom feeding debt collectors.
I have asked administration to delete your personal information. - Damienne Orthmann replies to MJGThank you very much for the information - I have also looked up the laws in CT on this matter and thankfully my brother happens to be a police officer in my town. I received a call from the "process server" today stating he will be to my house between 5-7 tonight and he is in luck, so will the local and State Police if he does show up.
- AnonymousI received a call from this number also. They stated they would file a civil or criminal complaint for a payday loan from 2008. The account they referred to was an account that had been closed a year earlier and the email they said I used to apply for the loan was from a job that I had in 2003. If it wasn't for this website and the information I saw I would have had money withdrawn from my account. After I sent them an email requesting all information regarding this debt be sent to me they actually had a Compliance Officer call me then he started talking about cyber bullying and they were sending this "supposed" debt back to their client. I haven't called them back and I won't be calling them. Thankfully they can't access any of my money and will not be able to ever.
