They have screwed me out of over $4000 over 4 years and still say I owe the same amount from 4 years ago! They lied to the judge got judgment and yes they did lie I at the time did not know they had to validate within 30 days by law they waited until I walked into the court and handed it to me and the judge. Of course I couldn't lie to the judge but I tried to explain I had problems with some of the charges didn't matter down went the gavel now I am stuck with a judgment and liens filed against me even though I only owe about $400 I am doomed to have to get a lawyer now! I have had them on me before Weltman crooks took over... They collect for Sears and Citi Cards mostly.

- ADVOCATE replies to teteValidation letters are sent to the last known address that their client forwards to them, if it is returned they try to find a new one and 30 days restarts for validation if not validity is considered and it is not their fault you do not have your mail forwarded to a current address. If your balance went up its called interest rates that yes still accrue after account is charged off and or sold to a debt collector but not once to a law firm, law firms represent their clients and do what their clients tell them to....much like if you hired an attorney to file a suit against someone.
- MickyEven just debts past the SOL which have not been successfully brought in suit before the SOL expiration date, cannot be collected unless you admit the debt to be yours and decide to pay them to go away. If you make that decision they know they have a live one and will bilk you for everything they can get. If you ignore them there is nothing they can do except report the account to the credit bureaues, (reports that you can challenge at the bureau if you like to waste your time), call you incessantly and send you nasty letters. All of that is quite harmless if you don't care about your credit history (or enjoy disputing these things in that arena), don't answer the phone calls and throw the letters away.
If the debt is not past its SOL and it is your just debt you are better off dealing with the original creditor to make restitution than trying to take care of it with ANY collection agency/law firm. If the debt is not past its SOL and it is not your debt, get a lawyer and go after them. It will likely cost you $1000 to $3000 in attorney fees to set things straight, but if you are lucky the collection agency may have broken a few rules under the FCRA/FDCPA regs that you have documentation for and you can counter-sue for punitive damages plus attorneys fees in some states and actually make some money on the deal.- Caller: Weltman, Weinburg, Reis, PLC

They have an incredible network of law firms across the country who sue on debt that were purchased for pennies, then many have arbitration claims files and/or sue upon. They buy themselves whatever they want and sometime, whomever they want to achieve their goals. To put this empire of scam in perspective here are some of the players:
Rumor is Wolpoff & Abramson (W&A) own the National Arbitration Forum (NAF); that is FALSE! They are the single largest supplier of claims to the NAF and at $ 250.00/per claim, it’s easy to see why they win approximately 95-98% of all claims filed.
This is further bolstered by the fact that NAF pays their arbitrators (attorneys, retired judges) a fee of $250/hour to handle claims. The rules state they must handle six claims per hour for this $250, so you can understand that any claimant would be lucky for even a cursory review of documents.
Buying bad debts for 2-3¢on the dollar (many for a lot less), paying the NAF $250 with an almost guaranteed award in your favor and a network of lawyers filing suits spells money on the level of a South American drug cartel to Wolpoff & Abramson.
W&A pulls the strings for NCAN; the National Collection Attorney Network which is comprised of over 100 law offices across the U.S. of attorneys who sue on debts. A few of these attorneys are good, honest, hard working, many more are inept, have very little understanding of the FDCPA, have no knowledge of any material facts other than what they are told to say and do. They get paid a contingency fee to show up in court, many never do, hoping to take default judgments.

Think your going to beat an arbitration claim? Not when the arbitrator is being paid $250/hour and can be fed claims all day long. Think your rights under the law mean anything? Think again! I have been contacted on hundreds, perhaps thousands of arbitration claims and only one attorney from Texas had the guts to stand up and say…”Hey! This is wrong!” The good news is he took his job seriously; the bad news is he is no longer an arbitrator for the NAF. Many of these arbitrators would feel very comfortable performing their jobs in a Nevada brothel as the two jobs perform similar services.

W&A also has offices in many cities where the phones and faxes all ring in at Rockville, MD. They use an auto dialer that calls some consumers as many as 20 times daily (according to complaints I received) and make it near impossible to get wrong persons removed. They file cases by the hundreds every day and reportedly even supply court clerks to work side by side with real court clerks to get the filings done.
Want to validate a debt? Fuggettaboutit! …Won’t happen! Slows them down, who gives a damn about the law and consumer rights? They have daily, weekly, monthly goals to hit. Besides, they will manufacture most documents in-house for court filings; even notarize them by employees attesting to hearsay facts that are not admissible in most courts.
Some smart consumer attorney may one day put W&A employees under oath and learn that Affidavits that are legally supposed to be signed in the presence of the person attesting to the truthfulness (?) of the documents, have instead taken them home to be stamped and signed because of the work load. Again, the law and consumer rights are not the issue at W&A, profits are!

- BusinessThis number calls DAILY in the afternoon - As soon as the words of our company is out of our mouths -before we can get to how may we direct your call - they hang up. It would not be so obvious had they not been doing it so long now that we recognize the number as a constant hang up.

I know: I get 3-4 calls monthly from VARIOUS sources about my ex of 17 years ago: it's easy to track down person links thru the web: and that's how they get my #. I also get calls for other persons with the same last name & different 1st name: but only 1st initials are listed in public directories. Usually a polite explanation of the facts that I am not who they are looking for, or "she's my ex from 17 years ago: let me know if you do because she still owes me child support!" takes care of it, until the debt is passed on to another company.

I had a serious accident five years ago and fell behind in some very small credit card payments $600.00 and $300.00 respectively. After some rehabilitation and unemployment finally coming in I made payment arrangements with Capitol One. I paid the $600.00 off first and then began to pay the $300.00 in the same increments. I was then notified that I no longer owed Capitol One any monies as they had "written the debt off"
Being in a tough situation, I thought this was a good thing. Well, a few years go by (5) and suddenly I get a call for a $1500.00 debt. I thought it was a mistake so I pursued it and was informed I was still being charged 25% interest on that $300 that was "forgiven" by capitol One in 2003. It seems that Cap One sold the debt for more than its actual worth rather than take payments to clear the debt. This is how this predatory company does business; by using tactics to cause late payments and penalties which skyrockets your account into maximum interest and hoping you fall behind. Anyway, I clear up the debt totally last year with that collection company. Now I find that they sold "the balance" to these sharks.
The same company bothered my elderly neighbors for a non-existent debt of $400.00 which they eventually paid to be rid of the annoyance after being threatened with their flawless credit being tarnished. They then received a phone call stating an overpayment had been made and a they wanted to send a refund for the $400.00 they collected. My elderly neighbors refused the refund and asked that they please stop bothering them and were promptly sued by the collection agency for the unpaid debt and court costs. They hired an attorney and paid several thousand dollars to have this cleared up. No action was taken against the collection agency. What can we do? I'm a fighter when it comes to peoples rights.
