- Nimrod replies to Poppy| 2 repliesNo doubt, that photo was only of the first page of the "summons". You cannot be served by text and when actually served (for a real lawsuit) the entire summons has to be delivered. Further, to sue for a debt, they have to do it in a Court in the county where you reside, and they have to give you ample time to reply to the Court and challenge the case (time allowed can vary somewhat but usually runs about 30 days).
You do not mention how much this supposed toll was, but (considering this is a scam anyway) what I would do is lay out the same amount in cash on a table top and take a photo of it and then text that back to them with the note "Paid in Full."
Some States are aggressive in going after unpaid tolls (sending them to debt collectors if previous mailings requesting payments go unanswered) and many have modified their laws so the registered owner is responsible for any toll violations regardless of who was driving at the time.
However, it is still a debt and the laws regarding debt collection still apply.
When dealing with any debt collector (real or fake) the following information is useful:

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contain a “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that dispute/debt validation request letter by certified, return receipt mail.
