    Highly Upset
So first they have some guy named "PAUL SHERMAN" call me from a "Unknown" number today saying he is calling on behalf of SCC Associates ( Shadow Creek Capital & Associates) and that HIS company would be serving me papers because SCC wants to take legal action because I wrote some bad check! I took his name however he said he couldn't give his number, but he did give me SCC's number so I called and left a message with them because I knew I hadnt wrote any bad checks. About a hour later SCC calls me back and they said that I owed money to a payday loan company which was true however when I explained to the man that I am in a financial hardship right now he starts going off on me telling me "well since you have job you should pay it and pay it now before youa re served the papers" I told him I would work it out with the payday loan company he said if I did that they would just refer me back to them but by then it would be too late and I would get the papers served to me and pay 3 TIMES MORE than what I could pay to him today, so I am going to contact the pay loan company and see where it goes from there. But from the looks of all these comments below, it doesnt look like I should even worry about it.

You need to be careful here.. Sure Paul Sherman stating they are serving you papers is border line but you stated the you talked to SCC themselves and you stated you owed a pay day lender. The one thing is that unless you wrote a check (brick and mortor PDL) and handed to them and they ran the check you did not write a bad check. You just defaulted on the loan because they have you ACH or the debit your account (no check just a turned down transaction). Ask for verification of lender and always remember to to get addresses and never pay via debit card or automatic withdraw.

Process serveers do not normally call yu to warn you. Most times you are served either by sherriffs or via certified mail.

    Be safe and good luck.

Post this Message under the number associated with the call to help others on this site & then tell your caller you want proof of debt in writing. If they won't, big red flag #1. Then call the Payday loan company you owe & ask if they sent it for collection. They didn't? Big red flag #2. Those two things will tell you all you need to know about the company calling. Big red flag #3- It is illegal for a collection company to threaten you. Check your State's web site for more info. Your caller is probably located in Asia, but you really should record these calls. Check your State laws to see if your State is legal for caller/receiver/notify/no notify

upset and mad replies to Highly Upset
I am getting calls from this Mike Regal and threatening me to serve papers and that I have a court date approaching and a warrent will be issued if I don't let him serve me or rather (and this sounds like what he would prefer) I call the company at 855-577-2534. The company is SCC and Associates. I guess from reading your post that this is fake. I have not written any bad checks. I am sick of this. I don't appreciate being made stressed out even more than I already am.

I got a call this morning from a man calling me from a blocked number to say he is a server, he is serving me over the phone.  His name is " Larry Svoboda", I should call SCC and Associate, a client is pursuing me for Fraud and bad checks.  First of all I do have personal checks at , he did not give me any information concerning himself and the call; first thing I think is scam!  I don't think I will be calling this number.

He claimed to be serving you "over the phone"??? How did you not laugh out loud at him? You must have better self control than I.

It's a scam. And not even a very good one.

    finally understaning
I have received one phone call on my personal cell phone and one on my home phone NOT FOR ME but for my sister, who I never speak to so not even sure how MR. MITCHELL would have gotten these numbers.  My sister is deaf so even if she did something like this person seems to be insinuating she would not be even be able to hear his RUDE and THREATENING messages.  I was tempted to call back but decided it is was not my business.  But am real glad I found this website.  I had a funny feeling this was not 100% legitimate. How stupid do some people think we are!!!

I wouldn't call them back. I WOULD talk to your payday lender just to make sure your account is OK and they haven't sold it - if they have sold it, they can tell you who bought the account.

If "Justin Cooper" calls you back, demand proof of debt. NEVER - and I mean NEVER - pay any caller who refuses to MAIL proof that you owe a debt and proof that they have the legal right to collect said debt. Refusal to mail this documentation to you means you owe the caller NOTHING - per the FDCPA (Fair Debt Collection Practices Act).

Got same call today but from a woman. I have a payday loan in default too. It must be some collection agency they sold the account to. It was a woman that called me. Anyway, I won't be returning their call any time this century.

First I got a call from a Paul Carter stating I have a bad check out then said I had an hour to resolve the claim voluntarily by either meeting with him to get the paperwork or I would be be served, and left a number for me to call. I called that number and got a Jennifer Reese in which she said it was from a ACE payday loan and that if I didn't make the payment they would garnish my wages and etc. It freaked me out at first until I searched "SCC A**." and found out this was all a scam. I am curious though as to how they got my information, they knew the last four of my social, that has been concerning more than anything,

The lies you heard are not confined to a single company. They are part of the playbook used by fraudulent PDL collectors everywhere. Recognize those lies and you'll never again be fooled by a stranger on the phone who wants money for a so-called "debt".

The first and most prominent ruse is claiming a "hot check" debt, subject to criminal penalty. A payday loan is a *consumer debt* and therefore a civil concern.

Does the agency own your alleged debt? Has the agency won a judgment against you? Is "Jennifer Reese" an attorney? Does your state permit wage garnishment to satisfy consumer debt? An answer of "no" to any of the above means the garnishment threat cannot be carried out. Empty collector threats are illegal per federal and state laws which thugs like these break every hour, because they cannot prove their claims.

"Pay us now or get served" is another empty and common threat, and logistically absurd. Real collection lawyers typically file their actions en masse and then arrange for process service within a few days. When that happens, it's not generally an ambush; the lawyer has already tried to collect conventionally through calls and letters.

} how they got my information

Have you ever applied for a payday loan? Note that I did not say "accepted", only "applied". Answer "yes" and you know why you're being targeted by extortionists. These lenders traffic in your sensitive data and their criminal friends monetize them. This has been discussed here many times. But first we have to get you hip to debt collection law, which also talks about the *correct way* to notify you about some moldy debt.

My notes from October 2011 on payday loan and "hot check" collectors are linked below, for reference against the South Asian faker variety. Since Shadow Creek appears to have a Buffalo area headquarters, you should consider launching a *real* lawsuit for denying your rights.

Chances are people bought his information, or I.D. theft.

He didn't whether he took a loan or out, but chances are he may have applied for one. Confusing situation.
