FTC Gets Court to Halt Phony Payday Loan Broker

At the request of the Federal Trade Commission, a U.S. district court has halted a Tampa, Florida-based operation that promised to help consumers get payday loans.  

Sean C. Mulrooney and Odafe Stephen Ogaga and several companies they controlled used consumers’ personal financial information to debit their bank accounts in increments of $30 without their authorization.

Claiming to be affiliated with a network of 120 potential payday lenders, the defendants misrepresented that 80 percent of applicants got loans in as soon as one hour, according to the complaint filed by the FTC.

In all, the defendants victimized tens of thousands of consumers, taking more than $5 million from their bank accounts.  Many of the victims were in difficult financial straits to begin with, and as an added insult, often began receiving harassing telemarketing and debt collection calls shortly after the defendants made their unauthorized withdrawals.

Consumers who complained to Defendants’ Philippines-based customer service agents were frequently offered refunds and $100 gasoline vouchers that never materialized.

Mulrooney and Ogaga apparently used proceeds from their illegal scheme to finance a lavish lifestyle.  Mulrooney is the registered owner of a 2012 Maserati GranTurismo, while Ogaga owns a 2011 Rolls Royce Ghost and a 2006 Ferrari 430, according to documents filed with the court.

    When somebody actually goes to jail maybe I'll get excited. All that really happens is the crooks regroup, get new phone numbers, and do it all over again. Because they CAN. Yeah, my tax dollars are working about as hard as any other government official.

    Actually, they CAN'T.  Or at least, they won't be able to, if the FTC's case is successful.  The FTC has only brought a civil lawsuit to redress injury to consumers resulting from violation of the FTC act, and a permanent injunction preventing the named defendants (which include not just their companies, but the individuals running them, according to the complaint) from engaging in such violations in the future.

    Violation of an injunction is a criminal rather than a civil matter.

    Plus, now that the states know who these people are, there is nothing to prevent one, or even several or all of them from filing separate criminal actions against these people.  That's NOT double jeopardy -- jeopardy is counted on a per jurisdiction basis, and civil lawsuits do NOT count at all.

    How happy I am they are being made to pay.  I guess for my part I kept filing complaints to anyone and everyone who would listen.  Vantage funding and Your Loan funding hit my accounts at 2 different banks several times before I could close them down.  Vantage funding also tried several times after I closed both accounts.  I guess my story to the bank manager was a big help.  Now if only they could do something with VIP loan shop.  I had never heard of them until they deposited money in to my account.  I had the bank help me return the money and closed the account. 24hrs after I closed the account Vantage funding tried to withdraw money from the closed account. I am just glad the bank knew what was going on and got their fraud department involved.  Again Oh Happy Day.

    Unfortunately it will never stop, they use Magic Jack phones, and can't be traced. When you call back the number it says you can't leave a message and there is no information about why they called. I had one that actually used a lawyers name in California, I contacted the lawyer and warned him that a company was using his name for leverage. They also told me that they didn't have to follow the laws in the United States.

    Big whoopee... Just a slap on the wrist by the FTC. I'm sure these SCAMMERS have already moved on to their next fraudulent endeavor. And why hasn't the FBI deported these [***]'s and seized ALL their property? But hey, the Feds are way to busy throwing glassblowers like Tommy Chung in prison for 2 years manufacturing tobacco pipes.

    has anyone recently been getting calls from a recorded message saying something about fraud charges being filed against you and your rights would be forfeited and your going to be served a summons. these calls come from now going on the third different phone number in a different state each time. all because of a payday loan back in 05' or 07'. a woman leaves a recorded and sometimes a man does. today a guy said he got a fax about charges linked to SSN and name.
    calls like that. has anyone received within the past two weeks.

    The problem is that they will change their names or use someone else s to continue to do what they do best.  That would be to continue to break the law. Change Company names, addresses and so on... Criminals don't care about getting caught because they will be back to work on their committing crimes same as usual..
