Response to Mr. Tayek @888-438-0878

Author: Julia Forte

Last night we received an email from someone named "Thomas Tayek" in regards to his business phone number 888-438-0878.

In the email Mr. Tayek is demanding that we

"take every single negative comment off of [his] work phone number or i will seek legal action against you because it is breaking the law to have false information posted on a website. i am asking one time for you to take these post off or i will take legal action as we are a law firm."

Mr. Tayek, here is our public response to your ultimatum:

  1. As a law firm you must know that it is NOT against the law "to have false information posted on a website".
  2. We cannot know if the statements are truthful. But we sure hope that this mix of people's opinions and experiences helps the community make their own conclusions and come to their own decisions.
  3. You are welcome to respond to false posts (or negative posts, as it appears you use the terms 'negative' and 'false' interchangeably) with truthful information. I am sure the users will appreciate it and your responses will answer many questions the community obviously has.
  4. Whether your company is a law firm or not, it does not change our moderation rules, which can be summed up as "if the TOS is followed the content stays".

Also please note that that if you sue us, we will FIGHT BACK, we WILL WIN, and you WILL PAY our legal fees. If you look through our news section, you will see that this is not an empty promise.

Attorney?? Lol, more like 5th grade drop out after reading his request! Perfect example of poor syntax and how about capitalizing? If Thomas does indeed work for a law office, he should immediate sue the education system because the failed him, HORRIBLY!

I find your post funny .I now am AMUSED as well.Perhaps if your post is pointing out someone else's
errors you might want to proof read your own post.
"he should immediate sue the education system because the failed him"
    Did you mean to write
"he should IMMEDIATELY sue the education system because THEY failed him?"
    Thanks for the laugh

Don't you hate it when people point out your spelling mistakes? I think it's RUDE and it takes the whole discussion off topic! Although I have to agree the writing style of this law firm representative is too conversational.

If this person were duly licensed to practice US law, why does google.com/search?q="Thomas+Tayek" only return two websites - this 800notes page and a 'rootsweb' geneaology entry claiming "Frank Thomas Tayek was born 28 MAY 1889 in Clayton County, Iowa, and died 6 AUG 1985"? Lawyers usually do use their personal legal name in connection with their professional practice, so I'd have expected *something* to come up?

I believe the threat was written by the same person who owns 888-438-0878, and is pretending to be a lawyer.  Manners of writing give it away.

    Thanks Rhonda for your comments.

However they may not help Julie's position that 800notes is ok with their platform of primarily unfounded comments, since they cannot know if the posted statements are truthful.
She hopes that the mix (true and untrue) of people's opinions and experiences helps the community make their own conclusions and come to their own decisions.

Your comments have helped me come to my own decision.

A little google here and google there, and a few minutes of reading and scrolling and... poof!, a factual account, flawless research and accurate summary.

Another one that believes everything on the internet is factual and reliable.

Don't like it?  Not true?  Fabricated?

Remember; just an opinion that helps the community make their own conclusions and come to their own decisions.

The grammatical inaccuracies suggest that we are dealing with foreigners attempting to masquerade as debt collectors, or a group of teenagers.  Law firm my ass; paralegals and lawyers have much better grammatical conditioning, since...you know, it's part of their job requirements!
