A Texas-based burger chain has sued one of the country's largest debt collectors, contending that NCO Financial Services is harassing an unidentified employee by making calls to the company's San Antonio corporate headquarters despite a cease-and-desist letter.

    The issue was settled out of court by What-A-Burger and the debt settlement company a long time ago. Time to move on to other things.

    The FDCPA never said that in its 35 year history. As explained repeatedly in this thread, (currently page 2) the statutory award is *capped* at $1k per action, *not* per violation. I disagree with "just Google it", since search results tend to yield more of the same misinformation.

    That amount did serious damage to violators before three decades of inflation and before collection agencies merged and bought each other like so many other businesses. The jackpot-sized damage awards which make news headlines tend to include actual damages and/or conduct which approaches human rights violation. Most of those few people who fight their collectors don't have problems anywhere near that serious.

    You are otherwise correct about a need for perspective. The opposition would have you think that an unpaid phone bill is somehow worse than murder. A process of collection or litigation comes down to a business decision. It's nothing personal to them, and it shouldn't be to you when you raise disputes. In that same sense of perspective, to make "even one mistake" in the effort may cost you far more proportionally than an error or violation costs the corporations.

    Just don't answer them!!! the first time you id the number, don't give in to the temptation to say a thing. these blood suckers hire morons who love to argue & demean. The worst thing they can get is no response. Every deal they might offer is pure lie and you can pay without listening to their phone henchmen so dont play thier game. Remember that if no one answered or you immediately hang up, these call centers would be silent  or theyd be yelling at themselves. Cmon they dont do anything more than raise your blood pressure, so why do that to yourself?? In short order, the centers would be worthless and shut down if no one answered thier calls - also it its frustrating to them - raise their blood pressure instead of yours. You may also want to gps their call map and find out where the call center is geographically located. Tell one of those scum what color the roof above them is and what the parking looks like & boy do they change thier tune quick - that was fun and I hope Mr. Smith quit that day after changing his diapers (he must had an open warrant - he didnt want to seen on tv LOL).

    Don't kid yourself.  I used to get calls of this nature at work all the time (for our employees).  Whenever I get a live one, as opposed to automated, I tell them that they can call all they want, but I won't ever get the employee for them.  They stopped trying.  YAY!

    Im currently having serious issues with a (former) landlord who sold my apt building to be torn down. I have not yet recieved the buyout money nor my deposit.

    wow, I can't help but make a comment after seeing ur post.  u must be out of ur mind to be so disrespectful nd to make such drastic assumptions.  the person before was stating that thy had been threatened at work 5 times a day nd sued them and won!  I was disturbed by ur holistic approach and went off the way u did. news flash honey most lawyers hired by people in debt usually take their fee only if thy win the case   so obviously lawyers like that won't touch a case with no grounds of winning. very ignorant of u to assume people that are in debt deserve to be harassed in such a manner nd don't deserve to be compensated if the courts agree it was harassment

    All these lowlife debt collectors hire only the most lowliest among us, so they must be treated in the same way by consumers. Resist the urge to pick up the phone to them, since that's their goal. If you must, invest in a phone that records. By these cretins calling the guy's corporate office to complain, they violated federal consumer privacy laws. This issue can be brought to the courts, in addition to filing a report with the federal government. Whatever action you're going to take make sure it's recorded, documented, and filmed (if necessary) in addition to reporting it to federal agencies. Deal with the feds as much as is needed and necessary.

    He is probably a debt collector and is mad cause he is part of the problem and got hammered in court and ruined by a creditors lawyer...........
