- DJThink we've only gotten 3-4 calls from this scum -- so far. They are most likely looking to collect old credit card debt of my mother's. Mom is 85, has dementia and every other old person disease known to man. She's very close to death and has no income or assets other than her social security check. That, they can't touch. We just let 'em talk to the answering machine if they so desire. Most of the time they don't. They're going to put a judgement on her? Ruin her credit? Oh dear. What does a penniless old woman on her death bed need with good credit?? They can't get blood out of a turnip. Her debt will die with her.

That way the lawyer-principals in this firm can escape sanctions from the local bar authorities. But they can't escape the FTC. Report them if they are harassing you.

- Resident47 replies to LaurieI expect you are attaching your comments to mine and not trying to teach me what the FDCPA says. The standard of debt validation needed is really quite low, despite suggestions like yours and frantic all-inclusive demands found in extremely flawed template letters to collection agencies. They don't need a "contract" signed or otherwise to validate. The popular category of credit card accounts won't have a contract with signatories in the first place.
Let us also not swoon before that old "you don't have an agreement with collectors" fallacy. The third party collector does not need any new contractual agreement executed with a consumer to do its job. It relies on the contract clause from the original creditor which says that its terms can be enforced by a subsequent debt buyer and a creditor can send any hired guns it likes to collect.
Proper validation identifies a creditor, an amount, and just enough to make a debt claim plausible. Some creditors send a half-inch stack of paper, others a couple sheets, depending on their plans for you and their assessment of how much trouble you'll create. If you want to go to the mat for more parts and accessories, you'll have to wait until discovery in a court case.
All said, what trashy junk debt chasers send for validation, if they bother to reply at all, is frequently defective or a total joke, and often not obtained from an original creditor as the FTC has benchmarked. OC's usually do a better job of validating, but even so, the consumer does not have to agree with all parts of the document dump and should still comb it for holes. - B-RadI just received a letter today from P.Scott Lowery claiming I owed money to Bank of America. The first thing I did was call B of A to confirm I didn't owe any money and they confirmed that I paid my debt a year before.
